corpora(Tn— o cof mmence, con uc , <br />maintain, or carry on or employ any <br />.other Person to do so, in any part of <br />the city of Newport Beach outside of <br />the district, zone, or portion of said <br />city described In Section 1 of this <br />Ordinance the business of drilling for, <br />developing, producing, storing, or re- <br />fining petroleum, oil, gas, or any <br />'other hydrocarbon substance, and <br />every day that any such person, firm, <br />co-partnership, association of persons, <br />or corporation does conduct, main- <br />tain, or carry on any such business, <br />or attempts to do so, shall be and <br />constitute a new and separate offense. <br />This section is not intended to pre- <br />vent and shall not be construed as <br />preventing the storage of the refined <br />Products of petroleum ready for sale <br />and use at the places and in the quan- <br />tities now.permitted by the ordinances <br />of the city of Newport Beach. <br />SECTION 6. <br />Every person who shall be found <br />guilty by a court of competent juris- <br />diction of a violation of this ordinance <br />or any of its provisions or of any act <br />or ommission therein declared to be <br />unlawful and to constitute a misde- <br />meanor, shall be punished by a fine <br />not exceeding $250.00, or imprison- <br />ment for a period not exceeding thirty <br />days, or both such fine and imprison- <br />ment in the discretion of the court. <br />In addition to the foregoing penalties <br />every nuisance existing in violation <br />of this ordinance shall be at once <br />abated. <br />The above and foregoing Ordinance <br />shall be published once in NEWPORT <br />NEWS, a newspaper of general circu- <br />lation printed, published and circulat- <br />ed in the city of Newport Beach, and <br />shall take effect and be in force thirty <br />days from and after its passage. <br />I hereby certify that the above and <br />foregoing Ordinance No. 275 was pass- <br />ed at a regular meeting of the Board <br />of Trustees of the city of Newport <br />Beach held on the 6th day of April, <br />1925, by the afffirmative vote of the <br />following named members thereof: <br />Ayes, Trustees — WILSON, SLOAN, <br />YOUNG, RICHTER, WILKINSON. <br />Noes, Trustees —NONE. <br />Absent, Trustees —NONE. <br />Attest: V_ A. WILSON, <br />President Board of Trustees <br />City of Newport Beach_ <br />NORDINANCE NO. 276. <br />A5 ORDINANCE OF THE CITY OF <br />EWPORT BEACH FIXING THE <br />t RATE OF LICENSE AND TIME OF 1. <br />PAY3IENT THEREOF FOR CON ` <br />DUCTING CERTAIN BUSINESSES <br />OR CALLINGS IN SAID CITY, AND <br />PRESCRIBING A PENALTY FOR <br />ALL VIOLATIONS OF THIS OR- <br />DINANCE. <br />The Board of Trustees of the city of , <br />Newport Beach do ordain as follows: <br />SECTION 1. <br />Every person, firm, or corporation f <br />who shall engage in the business of <br />;selling or delivering ice in the city <br />of Newport Beach, not manufactured <br />in said city, shall pay a license of <br />,$150.00 per month, and which shall be <br />paid monthly in advance and prior to <br />engaging in any such business. <br />SECTION 2. <br />Every person, firm, or corporation <br />tconducting, engaging in, managing or <br />carrying on the business of selling <br />upon the public streets, or in any <br />public place in the city of Newport <br />1 Beach, fire works, fire crackers, tor- <br />pedoes, or fire works display of any <br />kind, flags, banners, pennants, balls, <br />canes, horns, trumpets, or noise -mak- <br />ing instruments of any kind, toys, <br />badges, balloons, or souvenirs of any <br />description, or maintaining weighing <br />machines, or guessing contests, or <br />who operates a hand organ or other <br />musical apparatus, shall pay, daily in <br />advance, a license of $10.00 per day.. <br />SECTION 3. <br />Every person who shall engage or _- <br />attempt to engage or who maintains <br />or carries on any of the businesses <br />mentioned in this Ordinance without <br />having first procured and paid for a <br />valid license to do so in the amounts <br />provided for in this Ordinance shallf <br />be guilty of a misdemeanor, and upon <br />conviction in a court of competent 4 <br />jurisdiction shall pay a fine not ex- <br />ceeding $100.00 or imprisonment not <br />exceeding thirty days, or by both such <br />fine and imprisonment in the discre- <br />tion of the court. <br />SECTION 4. <br />The above and foregoing Ordinance <br />shall be published once in NEWPORT, <br />NEWS, and shall thereupon take ef- <br />fect and be in force. <br />This Ordinance was passed at a <br />regular meeting of the Board of <br />'Trustees of the city of Newport Beach <br />held the tat day of June, 1925, by the <br />'vote of the following named members <br />of the Board of Trustees thereof, to- <br />wit: <br />j Ayes, Trustees —GEO.
