tendent of the municipaT water sys- <br />tem, desclibing the premises to be <br />connected therewith, the else of the <br />pipe by Which the connection is desir- <br />ed to be made, setting forth the ad- <br />dress of the owner and the person to <br />whom all notices are to be mailed; the <br />said application shall contain an ex- <br />press agreement on behalf of appli- <br />cant that the water to be used on the <br />premises shall in all respects be used <br />subject and subordinate to the ordin- <br />ances and orders of the Board of <br />Trustees and lawful regulations of <br />the Superintendent of the water sys- <br />tem, and that the owner of the prem- <br />ises will cause to be ,paid at the <br />times and in the manner specified, all <br />charges for water furnished at the <br />rate and in the sums specified by the <br />Board of Trustees, and that all such <br />charges shall be a lien against the , <br />premises described in the application <br />until the same are paid. <br />SECTION 8. <br />The city of Newport Beach shall <br />have the right to instaII meters on all <br />Premises to which water is supplied <br />or is about to be supplied, and to <br />collect such charges therefor as may <br />from time to tike be ordered by the <br />Board of Trustees; when meters are <br />installed all water furnished shall be <br />measured through such meters; all <br />meters installed shall be and remain <br />the property of the city of Newport <br />Beach. Every owner of premises. <br />where a water connection is made <br />shall place on the property side of the <br />connection. so that the water may be <br />shut off, a suitable service cock. <br />In making connection of premises <br />• with the municipal water system of <br />the city of Newport Beach the con- <br />nection will be brought to the inside <br />of the curb on the front of the prop- <br />erty or to the side or rear thereof, <br />at the expense of the city, if there is <br />a city water main within 100 feet <br />thereof; when there is no city water <br />main within 100 feet all of the labor <br />and materials necessary to install <br />water pipe for the additional distance, <br />shall be ,paid for in advance by the <br />applicant. <br />SECTION 9. <br />All excess water may be sold by the <br />city of Newport Beach to consucuers <br />outside of said city in the manner pro- <br />vided by law. <br />Every person who shall do or fail to <br />do any act in this Ordinance declared <br />to be a misdemeanor, shall, upon con- <br />viction thereof in a court of compe- <br />tent jurisdiction, be punished by a <br />fine not exceeding $100.00 or impris- <br />onment not exceeding 30 days, or by <br />both such fine and imprisonment in <br />the discretion of the court. <br />SECTION 10. <br />All ordinances and parts of ordin- <br />ances in conflict with this ordinance <br />are hereby repealed, excepting Ordin- <br />ance No. 171. <br />SECTION 11. <br />The above and foregoing Ordinance <br />shall be published once in NEWPORT <br />NEWS, and shall thereupon take ef- <br />fect and be in force. <br />This ordinance was duly introduced <br />before the Board of Trustees of the <br />city of Newport Beach at a meeting <br />thereof held on the 18th day of May, <br />LIM& and Passed at a Ineeting thereof <br />held the 1st day of June, 1925, by the <br />vote of the following named members <br />of said Board of Trustees, to-wit: <br />Ayes, Trustees —GEO. SEBRING, <br />Clerk City of Newport Beach <br />. 2-I R <br />AN ORDINANCE OF THE PITY OF <br />NEWPORT BEACH IN AID OF <br />SAFETY AND NAVIGATION, ES. <br />TABLISHING THE OFFICE OF <br />LIFE SAVING AND PILOT SERV- <br />ICE OF THE CITY OF NEWPORT <br />BEACH, AND PROVIDING FOR <br />THE APPOINTHENT OF A PER. <br />SON TO FILL SAID OFFICE. <br />The Board of Trustees of the city of <br />,Newport Beach do ordain as follows: <br />SECTION 1. <br />In order to aid in the safety of <br />navigation in the waters of Newport <br />Harbor, there is hereby created in the <br />city of Newport Beach the office of <br />life saving and pilot service for said <br />city. <br />1 SECTION 2. <br />The Board of Trustees of the city <br />of Newport Beach shall have power <br />to appoint a person to fill said office, <br />to be known as Port Pilot, of Newport <br />Harbor, who shall hold office during <br />-the pleasure of the Board of Trustees,, <br />and receive such compensation as may <br />from time to time be fixed by the <br />Board of Trustees and which shall be <br />paid monthly. <br />SECTION 3. <br />The Port Pilot shall have authority <br />to designate such number of pilots <br />as to him shall appear necessary for <br />the efficient performance of the re- <br />quired service; the persons desig- <br />nated by the Port Pilot shall receive <br />the compensation designated by him, <br />and such pilots shall have the right <br />to collect such compensation from <br />persons for whom they perform pilot <br />service. <br />SECTION 4. <br />The Port Pilot shall have authority <br />to prescribe regulations governing <br />the action of himself and pilots desig- <br />nated by him provided that such <br />regulations shall at all times be keep- <br />ing with the subordinate to the rules <br />and regulations governing like service <br />prescribed by the State of California, <br />and the United States government. <br />The rules and regulations and <br />compensation to be charged for serv- <br />ices shall be compiled and printed In <br />convenient form so that the necessary <br />information may be furnished to per - <br />sons desiring to employ the services <br />of pilots. <br />SECTION 5. <br />The city of Newport Beach shalt <br />not be responsible or held responsible <br />for any accident, injury or damage <br />suffered or sustained by the Port <br />Pilot, or any pilot designated by him, <br />or any person, or the ,property of any <br />person, for whom the pilots render <br />or attempt to render service, or for <br />the failure of any pilot to render suc- <br />cessful service; the Port Pilot and <br />all pilots designated by him, shall <br />accept the appointment or designation <br />with the full understanding of the <br />non - responsibility of the city of New- <br />port Beach, and any person employing <br />any of said pilots shall employ .hem <br />only under such conditions. III <br />SECTION 6. <br />The above and foregoing Ordinance <br />shall be published once in NEWPORT <br />NEWS, and shall thereupon take ef- <br />. fect and be in force. <br />This Ordinance was duly introduced <br />before the Board of Trustees of the <br />city of Newport Beach at a meeting <br />thereof held on the 18th day of May, <br />1925, and passed at a meeting held <br />the 25th day of May, 1925, by the vote <br />of th efollowing named members of <br />said Board of Trustees. to -wit: <br />Ayes, Trustees- --GEO.
