TIVE BRANCH OF SAID CITY, ORDERING THE SUBMISSION OF THE PROPOSITION OF INCURR. ING A BONDED DEBT FOR THE PURPOSES SET FORTH IN RES. OLUTION NO. 337 OF SAID CITY, TO THE QUALIFIED VOTERS OF THE CITY OF NEWPORT BEACH, CALLING AN ELECTION TO BE HELD FOR THAT PURPOSE, RE- CITING THE OBJECTS AND PUH- POSES FOR WHICH THE INDEBT. EDNESS IS PROPOSED TO BE EN. CURBED, THE ESTIMATED COST OF THE PROPOSED PUBLIC LY- PROVEItENT, THE AMOUNT OF THE PRINCIPAL OF THE IN. DEBTEDNESS TO BE INCURRED THEREFOR, AND A MAXIMITMH RATE OF INTEREST TO BE PAID• ON SUCH INDEBTEDNESS, AND FIXING THE DATE ON WHICH SUCH ELECTION WILL RE HELD, I THE MANNER OF HOLDING SUCH ELECTION, AND THE VOTING FOR Of? AGAINST INCURRING SUCH INDEBTEDNESS, AND PRO. TIDING THAT IN ALL PARTICU. LARS NOT RECITED IN THIS ORDINANCE SUCH ELECTION; SHALL BE HELD AS PROVIDED BY LAW FOR HOLDING MUNI. CIPAL ELECTIONS IN THE CITY OF NEWPORT BEACH. Whereas, the Board of Trustees of the City of Newport Beach, as the I legislative branch thereof, at a reg -; ular meeting thereof held on the 30th: day of July, 1925, by the vote of two - thirds and more of all the members of said Board of Trustees passed Resolution No. 337 of the City of Newport Beach, determining that the public interest and also the public necessity demands the completion by the City of Newport Beach of the mu- nicipal water works thereof as set forth and described in Resolution No. 337, the cost of which will be too great to be paid out of the ordinary annual Income and revenue of the municipality;, New therefore, at this, a subse -• quent meeting of the Board of Trus- tees of the City of Newport Beach, after the passage of Resolution No. 337, and held the 10th day of August, 1925, the same being a regular meet- ing thereof — The Board of Trustees of the City of Newport Beach do ordain as fol- lows: SECTION 1 It having been determined by Res- olution No. 33, Of the City of New- port Beach, passed by the vote of two- thirds and more of all the Mem- bers of the Board of Trustees of the City of Newport Beach as the legis- lative branch thereof, that the public interest and also the public necessi- ty demands the completion by the City of Newport Beach of the muni- elpal water works thereof In order to carry out the objects, purposes and powers of the City of Newport Beach, the cost of which will be too great to he paid out of the ordinary annual income and revenue of the City of Newport Beach. the City of Newport 13eaca. The maximum rate of interest to ,bc paid on such indebtedness shall be and is hereby fixed at six per can- turn, per annum, payable semi -an- nually, which rate Of interest shall .not be exceeded fti the issuance of ;bonds for such indebtedness. SECTION 2 The Board of Trustees of the City of Newport Beach hereby orders the submission of the proposition of in- curring a bonded debt by the City of Newport Beach for the completion of the municipal water works there- of in the sum of $350,000, being for the objects and purposes set forth in Resolution No. 337 and bereinbe- fore in this Ordinance described, to the quaP.tied voters of the City of Newport 11j, ' aOi ::ad icr that pvrposr; an election is :iercby called and or- dered to be held W a7@ within Ibe Ci!.y of Newport Beo�h on Thursday, the 10th day of September 1925, which day is hereby fixed as the date on which said election will be held, and the election shall be a special elec- lion _ It Is hereby further and also de- termined and declared that the Board of Trustees of the City of Newport Beach propose to incur a.bonded debt and to issue and sell the bonds of the city of Newport Beach to pay the cost of the completion of the muni- cipal water works of the City of Newport Beach, as set forth in said Resolution. The objects and purposes for which the indebtednes% is proposed to be incurred is the completion of the mu- nicipal water works of the City of Newport Beach, consisting of the ac- quisition by the City of '.Newport Beach of additional water bearing land upon which to drill wells for the production of water, rights of way on which to construct and main. tain pipelines for conveying water, a reservoir site upon which to con-1 struct and maintain a reservoir for the storage of water, also the acqui- sition of pumps, engines, pipe, ma- cbnlery, apparatus, appliances, and all other necessary property with which to construct, and the con- struction by the City of Newport Beach of water wells, pumping plants, storage reservoir, and pipelines ' toil the production, storage. and convey- ance of water for the extinguishment Of fire, the flushing of public sewers, the cleansing of public streets, and All other municipal .purposes of the City of Newport Beach, and fior the domeslic use of 'the inuabftants there -' of. The special election shall be held at and in special election precinct No. 1 at the council chamber of the Board of Trustees of the City of Newport Beach, in the City Hall of said City, and which council cham- ber is hereby designated as The .poll- ing .place for 'Special election :pre :tinrt No 1 A Board of Eelectnon is hereby ap- pointed in and for special election precinct No. 1, consisting of one in- spector, two judges and three clerks, each of whom is a resident and reg- istered qualified elector of said pre- cinct as follows: Inspector —H. The special election shall be held at and in special election precinct No. 2 at the East Newport Garage on the southwest corner of Island and Bay Avenues, City of Newport Beach, which garage is hereby des- ignated as the polling place for spe- cial election precinct No. 2. A Board of Election is hereby ap- ponted in and for special election precinct No. 2, consisting of one in- spector, two Judges and three clerks, each of whom is a resident and reg- istered qualified elector of said pre- cinct as follows: hnspector —H. The special election shall be held at and in special election precinct No. 3 at the Fire Hall at Balboa, which Fire Hall is hereby designated as the polling place for special election pre- cinct No. 3. A Board of Election is hereby ap- pointed in and for Special election precinct No. 3, consisting of one in- spector, two judges and three clerks, each of whom is a resident and reg- istered qualified elector of said pre- cinct as follows- Inspector—L. L. Garrlgues.. Judge —Mrs. Cordie Rodger. Judge —Mrs. Evelyn Rider . Clerk—George Robinson. Clerk —W. A. Eastlack. Clerk —Glenn C. Wallace. SECTION 5 The polls at the polling places hereinbefore designated and estab- lished in each of the special election precincts must be opened at six o'clock a, m, on the day of election and kept open until seven o'clock p. m, of the same day, when the polls' shall be closed, except as ,provided � for in Section 1164 of the Political Code of the State of California. SECTION 6 In all particulars not recited in this Ordinance said special election shall be held and conducted as pro- vided by law for holding municipal elections in the City of Newport Beach. SECTION 7 Any qualified voter may, at said special election, vote in favor of the Proposition submitted by stamping a cross (X) on his o' her ballot in the voting square at the right of the . word YES following the proposition Voted upon, and any qualified voter imay, at said special election, vote against the proposition submitted by stamping a cross (X) upon his or her ballot in the voting square at the right of the word NO following the propostion voted upon. If any voter at said special election shall have stamped a cross (X) in the voting square at the right of the word YES following the proposition to be Voted upon, his or her ballot shall be counted iu favor of the is- suance of the bonds mentioned, in the proposition, and if he or she shall have stamped a cross (X) in the vot- ing square at the right of the word NO following the proposition to be voted upon, his or her ballot shall be counted against the issuance of the bonds mentioned in the proposi- tion. r If two - thirds or more of all the voters voting at such special election shall have voted YES and in favor of the proposition submitted, then the issuance of the bonds mentioned in the proposition shall be authorized and will be issued and sold by the City of Newport Beach for the objects and purposes and iu the sum of the principal of the indebtedness to be incurred therefor, as set forth in Resolution No. 337, described in this Ordinance, and stated on the ballot. SECTION 8 There -being no newspaper publish- ed in the City of Newport Beach six days a week, this Ordinance shall therefore be published once a week for two weeks in NEWPORT NEWS, a newspaper printed, published and circulated in the City of Newport Beach, less than six days a week, to- wit: once each week, and this ordi- nance and the ,publication thereof as provided for in this Section shall. constitute a notice of such special election, and no other notice of such Special election need be given. SECTION 9 This Ordinance being an ordinance calling and otherwise relating to an elVtion, the same shall go into ef- fect and be in force from and after its final message, The foregoing Ordinance No. 2S1 was passed at a regular meeting of the Board of Trustees of the City of .Newport Beach, as the legislative branch thereof, held on the 10th day of August, 1925, by the vote of more than twb4ldrds of all the members of the said Board of Trustees. and on said day was signed and approved by the President of the Board of Trustees of the City of Newport Beach, the said Ordinance being pass - -ed by the affirmative vote of the fol- lowing named trustees: -AYES, Trustees, Wilson, Sloan, Young, Wilkinson.
