BE ERECTED IN THE CITY OF NEWPORT BENCH, PRESCRIB- ING A PENALTY FOR ALL YIOLATIOiNS OF THIS ORDIN- ANCE, AND FURTHER DE. CLARING BILL BOARDS, THE HEIGHT AND PLACE OF ERECTION OF WHICH IN THE CITY OF NEWPORT BEACH DO NOT CONFORM TO THIS OR. DINANCE, TO CONSTITUTE NUISANCES. AND ORDERING THE DMDLITE ABATE)IENTI THEREOF, i The Board of Trustees of the city of Newport Beach do ordain as follows: SECTION 1. A bill board for the purposes of this ordinance is defined to be a structure erected and standing at a fixed place constructed for the purpose of displaying thereon, by means of paint, paper. or other substance. advertising of any character or for any purpose. not constructed upon any building. SECTION 2. No bill board shall be here- after constructed or maintained in the city of Newport Beach. the height of which, or the highest line Of which shall exceed six feet from the natural surface of the earth at the place where said bill board is erected and maintained. SECTION 3. No bill board shall be hereafter lconstructed or maintained in the city of Newport Beach on any (,property owned by the city or dedicated to the city of Newport Beach for public, purposes. No bill lboard shall be hereafter construct - ed or maintained in the city of Newport Beach on private prop- erty or property owned or held �n private ownership closer than ten feet to the nearest street line upon which any such property abuts or is bounded thereby. SECTION 4. Every bill board hereafter con -t strutted and maintained in the city] +of Newport Beach of a height) greater or at a place other tha J n) in this ordinance provided, shall constitute a nuisance and shall be immediately removed upon de- . mand of the city marshal Of the City of Newport Beach, and if not so removed by the owner or per- son in possession thereof it shall: be the duty of the Marshal of the) city of Newport Beach to summer- fly and immediately take the said bill board down. SECTION 5. Every person, including the own- er, agent, servant or employe, who shall in the city of Newport Beach hereafter construct or attempt to construct in the city of Newport Beach any bill board of a height or at a place not in conformity with the provisions, of this ordin- ance shall b eguilty Of a misde- meanor and upon conviction there- of in a court of competent juris- diction shall be punished by a fine not exceeding $250.00, or by im- ' Prisonment in the city jail not exceeding thirty days, Or by both l such fine and imprisonment in the tllscretion of the court, SECTION i3. The above and foregoing Ordin- ance No. 294 shall be published once in NEWPORT NEWS, a news- paper of general circulation print- ed, published and circulated In the city of Newport Beach, and it shall take effect and be in force from and after its passage. The above and foregoing Ordin- -ance No. 294 was regularly intro- duced before the Board of Trustees Of the city of Newport Beach at a regular meeting thereof held the 22nd day of February, 1926, and Passed at a regular meeting there- of held the 8th day of March, 1926. by the affirmative vote of the fol- lowing named members of said Board of Trustees, to -wit: Ayes, Trustees — WILSON, SLOAN, YOUNG, RICHTER, WILKINSON. NOes, Trustees —NONE. Absent, Trustees —NONE. The above and foregoing Ordin- ance No. 294 is hereby approved by me this Still day of March, 1926. GEO. P. WILSON, President Board of Trustees. The Board of Trustees of the laity of Newport Beach do ordain as follows: SECTION I.
