ORDINANCE NO. W. <br />AN ORDINANCE GRANTING PA- <br />CIFIC ELECTRIC RAILWAY <br />COMPANY, A CORPORATION, <br />AUTHORITY TO CONSTRUCT <br />AND MAINTAIN POLES AND <br />WIRES IN CENTRAL AVENUE <br />IN THE CITY OF NEWPORT <br />BEACH. <br />WHEREAS, Pacific Electric Rail- <br />way Company, a Corporation, now <br />maintains a line of Its railway sys- <br />tem over and along a private right- <br />of -way lying between the northerly <br />and southerly roadways of Central <br />Avenue in fhe City of Newport <br />Beach, California, using as motive <br />power therefor electricity, and <br />which railroad, is now constructed <br />with center pole construction; and <br />WHEREAS it is the desire of thel <br />City of Newport Beach that such <br />center pole construction be chang- <br />ed to side pole construction; and <br />WHEREAS, Pacific Electric Rail - <br />way Company has filed its applica- <br />tion dated December 3, 1928, for <br />franchise for such side pole con- <br />struction and maintenance of its <br />poles and wires for a period of fifty <br />years; and <br />WHEREAS, pursuant to said ap- <br />plication the City Council of the <br />City of Newport Beach did by Reso� <br />lotion No. 480 of said City, fix the <br />time and place for public hearing <br />on the application of the said Pa- <br />cific Electric Railway Company, for <br />said franchise, and directed that <br />jngtice be given thereof; and, <br />WHEREAS, notice was duly giv- <br />en as directed by said Resolution <br />and as required by law, and the <br />28th day of January, 1929, at the <br />hour of 7:30 o'clock P. M. at the <br />]chambers of the City Council of <br />j the City of Newport Beach, was <br />fixed as the time and place for <br />public hearing, opening of bids and <br />the awarding of said franchise; <br />and <br />WHEREAS, the public hear,(ng <br />was,held at the time and place ifx- <br />ed in said notice and all bids were <br />publicly opened and duly consid- <br />ered; and, - <br />WHEREAS, it appearing that the <br />Pacific Electric Railway Company <br />was the highest and best bidder and <br />that there were no other bids pre - <br />sented, or no other offers made <br />for said franchise, and said fran- <br />chise was duly struck off, sold and <br />awarded to the Pacific Electric <br />Railway Company. <br />NOW, THEREFORE, the City <br />Council of the City of Newport <br />Beach does ordain as follows: <br />SMUOn 1. That permission be <br />and the same is hereby granted to <br />Pacific Electric Railway Company I <br />to construct and for the period of <br />fifty years to maintain and operate <br />its trolley wires, trolley suspension, <br />wires, trolley feeder cables. trans- <br />mission lines, telephone wires and <br />other wires necessary or conven- <br />ient for the operation of its rallway, <br />supported upon side poles with <br />cross arms to be constructed ad- <br />Rtcent to and back of the curbs <br />which may be constructed, or curb <br />line, In Central Avenue over the <br />following described route, to-wit: <br />IIAlong the northerly side of <br />the northerly roadway of Cen- <br />tral Avenue and the southerly <br />side of the southerly roadway <br />of Central Avenue, between the <br />westerly side of Alvarado <br />Street and the easterly side of <br />"B" Street. <br />Section 2. That the center polo <br />,construction along the route here <br />tofore described may be remove[ <br />by, the Pacific Electric Railway <br />Company. <br />Section 3. The City Clerk shall <br />certify to the passage of this Or <br />dinance and shall cause the same <br />to be published once in Newport <br />News, a weekly newspaper, printed <br />Published and circulated in the City <br />of Newport Beach. <br />1 hereby certify that the fore- <br />going Ordinance was adopted by <br />the City Council of the City of <br />Newport Beach at its regular meet- <br />ing thereof, held not less than five <br />days subsequent to the introduc- <br />tion of this ordinance, and that the <br />same was adopted at the regular <br />meeting held on the 4th day of <br />February, 1929. <br />AYES, COUNCILMEN: Hilmer, <br />Clairs, Ellsworth, Williamson and <br />Mayor Johnson. <br />NOES, COUNCILMEN: None. <br />ABSENT, COUNCILMEN: None. <br />Attest: ALFRED SMITH. <br />City Clerk of the City of <br />Newport Beach. <br />Approved this 4th day of Febru- <br />ary, 1929. <br />MARCUS J. Ordinance of Inten- <br />tion No. 333 of the City of Newport <br />Beach, together with all proceed - <br />Ings had and taken thereunder, is <br />hereby repealed. <br />Section 2. Ordinance No. 342 of <br />the City .of Newport Beach, to- <br />gether with all proceedings had <br />and taken thereunder, Is hereby <br />repealed. <br />Section 3. All proceedings of <br />every nature and kind had or taken <br />relative to or In connection with <br />Municipal Improvement District. <br />No 6 of the City of Newport Beach, <br />are hereby annulled, vacated, set <br />aside and abandoned. <br />Section 4. This Ordinance shall <br />be printed and published once in <br />Newport News, a newspaper print- <br />ed, published and circulated in the <br />City of Newport Beach and shall <br />take effect and be in full force <br />thirty (30) days after its passage. <br />The above and foregoing Ordin -' <br />ante was introduced at a regular <br />meeting of the City Council of the <br />City of Newport Beach, held on <br />the 4th day of February, 1929, and <br />was finally passed and adopted on <br />the 11th day of February, 1929, by <br />said City Council at an adlourned <br />regular meeting thereof, by the <br />following vote, to -wit: <br />AYES.
