AN ORDINANCE OF THE CITY OF NEWPORT BEACH PRO- HIBITING THE USE, WITHIN THE CORPORATE LIMITS OF SAID CITY, OF CERTAIN IN- TERNAL COMBUSTION EN- GINES, EXCEPT THAT THEY BE MUFFLED SO AS TO DEADEN THE SOUND OF EX- PLOSION THEREOF, WHILE IN OPERATION AND PRO- VIDING PENALTIES F O R THE VIOLATION THEREOF. The City of Newport Beach, by and through its City Council, does ordain as follows: SECTION I. It is hereby pro- hibited and declared unlawful for any person or persons to operate, ar cause to be operated, at and within the corporate limits of the City of Newport Beach, except as hereinafter provided, any internal combustion engine or other me- chanical device, the driving force of which is derived from the ex- plosion of alcohol, petroleum pro - ducts, or other substances, without first placing over the exhaust or exhausts of such internal com- bustion engine or mechanical de- vice, a muffler, so constructed as to, deaden the sound of the explos- ions thereof. SECTION 2. The, City Council of the City of Newport Beach may, when it deems the occasion war- rants, grant a special permit to hold a boat race in the course of .Which unmuffled engines may be used by the contestants, upon the waters of the open ocean and in .the waters of Newport Bay, within the City limits of the City of New- port Beach, along and over that certain course situated in the waters of Newport Bay and more particularly described as follows: Beginning at a point which bears south 61 degrees 00 minutes East, a distance of 500 feet from U. S. Station No. 130; thence North 61 de- grees 00 minutes West 500 feet from U. S. Station No. 130; thence along U. S. Bulk- head line to Station No. 127; thence in a direct line to U. S. Station No. 126; thence south 79 degrees 00 minutes East along U. S. Bulkhead line to U. S. Station No. 125; thence in a direct line to U. S. Sta- tion No. 175; thence South 61 degrees 00 minutes East along U. S. Bulkhead line to U. S. Station No. 170; thence South 61 degrees 00 minutes East 500 feet to a point; thence in a Northerly direction to the point of beginning. And, provided, further that such special permit of said City Coun- cil shall be for a period of time not exceeding ten (10) days in all of any calendar year hereafter, and shall not exceed eight (8) hours of any calendar day, the en- tire period of time for which such special permit is granted to fall between the hours of eight o1cf8cic A. M. and five o'clock P. M. SECTION 3. Ordinance No. 52 Of the City of Newport Beach is hereby repealed. SECTION 4. Any person oi` persons who shall violate any of the provisions of this ordinance, or shall do or commit any of the acts therein declared unlawful and prohibited, shall be deemed guilty of a misdemeanor and upon con- viction thereof by a court of com- pctent jurisdiction, shall be pun• ish,d by a fine not exceeding $50.00, or by imprisonment in the City Jail of Newport Beach, for a period not to exceed thirty (30) days, or by both such fine and im- prisonment, in the discretion of the Court. SECTION 5. This ordinance shall be published once in Newport News, a newspaper of general cir- culation, printed, published and circulated in the City of Newport Beach, and shall take effect and be in full force thirty days after ' its passage. I hereby certify that the fore- going Ordinance No. 413 was duly introduced before the City Coun- cil of the City of Newport Beach, at a regular meeting thereof held on the 3rd day of April, 1933, and passed by the following vote, to- wit: AYES, Councilmen: Claire, Ells --` worth, Garfield, Hilmer. NOES, Councilmen: None. ABSENT, Councilmen: Gordon. Attest: FRANK L. RINEHART, City Clerk. The above and foregoing Ordin- ance No. 413 having been duly passed by the City Council of the City of Newport Beach this 15th' day of May, 1933, is hereby signed and approved by me.
