ORDINANCE N0. 430 <br />AN ORDINANCE OF THE CITY OF NEWPORT BEACH <br />ESTABLISHING A PLANNING COMMISSION UNDER °THE <br />PLAiINING ACT ", ADOPTED BY THE LEGISLATURE OF <br />THE STATE OF CALIFORNIA, 1929• <br />0 <br />The City of Newport Beach, by and through its City Council, <br />does ordain as follows: <br />SECTION 1. There is hereby created a City Planning Commission <br />of the City of Newport Beach, under the provisions of that certain Act <br />of the Legislature of the State of California, signed by the Governor <br />of said State, June 17th, 1929, entitled: "An Act to provide for the <br />establishment of official master plans and the appointment of planning <br />commissions in cities, cities and counties, and counties; prescribing <br />the manner of adoption of such plans, portions thereof, amendments thereto <br />and composition thereof; prescribing the powers and duties of such <br />commissions; providing for the transfer thereto of the powers and duties <br />of other planning commissions; providing for the preparation, adoption <br />and recordation of precise street plans; providing for the control of <br />the construction of buildings within the lines of streets shown on such <br />precise street plans; providing for the levy of a special tax for the <br />• support of a planning commission and other acts pursuant to this act <br />and making certain expenditures legal charges against the funds of cities, <br />cities and counties, and counties and regional planning commissions; <br />providing for the establishment by cities, cities and counties, and <br />counties, of regional planning commissions, including two or more cities, <br />cities and counties, or counties, or a portion or portions thereof, or <br />both; making certain acts misdemeanors; and repealing other acts in <br />conflict herewith." <br />SECTION 2. Whereas, there is a Planning Commission in the <br />city of Newport Beach which was created pursuant to the laws of the <br />• State of California, in effect before the adoption of the Act of the <br />Legislature hereinabove named; said existing planning commissilon shall <br />continue, and the members thereof shall complete the terms for which <br />they were appointed, and shall thereafter be appointed in accordance <br />with the provisions of "`the Planning Act ", hereinabove referred to, with <br />the powers and duties provided in said Act in addition to the powers and <br />duties said Planning Commission already possesses. <br />The appointment and terms of said existing members of the <br />Planning Commission shall le- in accordance with Section 2 of "The <br />Planning Act" hereinabove specified. <br />. SECTION 3. This Ordinance shall be printed and published once <br />in NEWPORT JEWS, a newspaper printed, published and circulated in the <br />City of Newport Beach, and shall take effect and be in force thirty (30) <br />days after its passage. <br />The above and foregoing Ordinance was introduced at a regular <br />adjourned meeting of the City Council of the city of Newport Beach held <br />on the 11th day of February 1935, and was finally passed and adopted <br />on the 11th day of March, 1935 by said City Council at a regular meeting <br />thereof, by the following vote, to -wit: <br />AYES, COUNCILMEN: Gordon, Claire, Ellsworth <br />Garfield, Hilmar. <br />NOES, COUNCILMEN: None <br />ABSENT, COUNCILMEN: None. <br />The above and foregoing Ordinance is signed and approved by <br />me this 12th day of March, 1935• <br />Hermann Hilmar <br />Mayor of the city of Newport Beach <br />ATTEST: <br />Frank L.
