HomeMy WebLinkAbout458 - Contractor Regulations & Fees• • C1 J 0 n U ORDINANCE NO. 458 The City of Newport Beach, by and through its City Council, does ordain as follows: Section 1. Section 23, of Ordi- nance No. 393 of the City of New- port Beach is hereby amended to read as follows: "Contractors shall be either a general or a subcontractor. A general contractor shall be con- strued to be a person, natural or artificial, who enters into con- tracts to construct or repair buildings or structures of any kind in the City of Newport Beach, for a contract price or for a percent- age of its cost, where the value of any such structure when complet- ed or the contract price thereof shall be $50.00 or more. And, for the purpose of this section, every person, co- partnership, firm or corporation who shall commence the erection or construction of any building or structure or shall re- pair in any manner any building or structure in the City of Newport Beach ,shall be deem- ed a contractor as herein defined and shall be liable to pay the li- cense hereinafter provided for, providing that the contract price or the value of said structure or building when completed shall be more than $50.00, unless the ovm- er of said building or structure, or the owner of the land on which said building or structure is be- ing erected, constructed or repair- ed, shall first make a sworn state- ment that they are erecting, con- structing or repairing such build- ing or structure as the owner thereof, and that they have not entered into a contract either verbal or written, with any con- tractor or subcontractor, or, any person whatsoever, to erect or construct or repair said building or structure, and that said build- ing or structure is being erected or constructed or repaired by day labor at a stipulated wage (said wage to be specified in said state- ment) and further that they are making such representations i n order that said person will not have to pay the license fees here- in provided for and that each of said representations are true. The rate of license for a general contractor shall be $25.00 per an- num, except plumbing and plaster- ing contractors shall pay $100.00, and the and coY.positlon mntrac- two, shall pay $50.00 per annum respective:y. A subcontractor shall be con- strued to be a person, natural or artificial, who shall enter into con- tract with a general contractor. to construct or repair any portion of a building or structure, when the contract price thereof shall be $50.00 or more, and for the pur- pose of this section, any person, co- partnership, firm or corpora- tion who shall commence the erec- tion, construction or repair shall be $50.00 or more, shall be deemed a subcontractor, as herein defined, and shall be liable to pay the li- cense herein provided for unless the owner of said building or structure or the owner of the land upon which such building or structure is being erected, con- strutted or repaired shall first make a sworn statement that they are erecting, constructing or re- pairing a portion of such building or structure as the owner thereof and that they have not entered in- to a contract either verbal or written, with any contractor or subcontractor, or any person whatsoever, to erect, construct or repair any portion of said build- ing or structure and that a portion of said building or structure is being erected, constructed or re- paired by day labor at a stipulated wage (said wage to be specified in said statement), and further that they are making such representa- tions in order that said person, firm or corporation will not have to pay the license fees herein pro- vided for and that each of said representations are true. The rate of license per annum for any subcontractor shall be as follows, to -wit: For Plumbing Contractor $100.00 For roofing contractor ........ 25.00 For electrical contractor .... 25.00 For painting contractor ...... 25.00 !or plastering contractor.... 100.00 or cement contractor ........ 25.00 or brick contractor ............ 25.00 or tile and composition contractor .......................... 50.00 For sheet metal contractor 25.00 For hardwood floor finish- ers and layers ----- ----- ---- - ----- 25.00 For carpenter labor con- tractor . ....................... ...... .. 25.00 For plate glass setters ...... 25.00 For chimney contractor .... 25.00 For all other subcontrac- tors of any other trade or craft ............................ 25.00 No license shall be granted to any contractor or subcontractor hereunder without a written appli- cation being made therefor, which said written application shall show the number of the State License, and whether or not said applicant is carrying Workmen's Compensa- tion Insurance on his employees, the company in which said Work- men's Compensation Insurance is carried. and the approximate a- mount thereof." Section 2. There is hereby add- ed to Ordinance No. 393 of the City of Newport Beach a new sec- tion to be known as Section 93, to read as follows: "The rate of license for conduct- ing the business of a penny arcade as that term is herein defined shall be fifty cents (500 per an- num for each instrument installed, attached or operated in said Penny Arcade, and the term Penny Ar- cade as used in this ordinance is intended to mean and shall mean Arcade or place of amusement where coins, disks, slugs, balls or other representatives of value, (not to exceed in value the sum of one (1) cent, are used, drop- ped or placed in any music box. phonograph, picture machine or other device or apparatus, used for the purpose of entertainment, post cards, fortune cards or tests of skill or strength, and it is further provided in this connection that no business shat: be considered a Penny Arcade business until there has been installed and in operation under one roof, at least seventy - five (75) instruments or machines of amusement. The operator, owner or lessee of said business need not pay the fees provided for in the other ordinances of the City of Newport Beach, except where said machines shall use coins or other considerations of a value in excess of one (1) cent, and if said machines shall use coins or other considerations of a value in excess of one (1) cent for the operations thereof, then and in such an event the operator, owner or lessee of said machine or machines shall pay the license fee provided for in other license or- dinances of the City of Newport Beach." Section 3. Section 55 of Ordi- nance No. 393 of the City of New- port Beach is hereby amended to read as follows: "The rate of license for con- ducting the business of selling new or used automobiles shall be $25.00 per annum, and in this con- nection if used automobiles are sold in connection with new auto- mobiles, even though said business is conducted on a separate lot or separate premises, the rate of li- cense shall be $25.00 per annum." Section 4. There is hereby add- ed to Ordinance No. 393 of the City of Newport Beach a new sec- tion to be known as Section 79 -a, to read as follows: "No license shall be granted in the City of Newport Beach for conducting and operating, within said City, the business of rent ing motorcycles, motor glides, motor scooters or motor bicycles, or any two or three wheeled moto^ driven vehicles, or any similar de- vice, irrespective of trade name or construction, and the busi- ness of conducting or operating a rental service of the above men- tioned motor vehicles, is hereby declared unlawful in the City of Newport Beach. Section 5. The City Clerk of the City of Newport Beach shall cause this ordinance to be published once in Newport News, a news- paper of general circulation, printed, published and generally circulated in the City of Newport Beach, and shall take effect and be in force thirty days after its passage. The above and foregoing ordi- nance was introduced at an sQ- ]ammed regular meeting of the City Council of the City of New. port Beach held on the 3rd day of May, 1937, and was finally passed and adopted on the 17th day of May, 1937, by the City Council of the city of Newport Beach at an adjourned regular meeting thereof by the following vote, to -wit: AYES, COUNCILMEN: Gordon Claire, Whitson, Williamson.
