HomeMy WebLinkAbout466 - General Municipal Election - 04-12-19380 • • ORDINANCE NO. 466 AN ORDINANCE OF THE CITY OF NEWPORT BEACH, PRO- VIDING FOR THE LEVY AND COLLECTION FOR EACH FIS- CAL YEAR OF A TAX OF FIVE CENTS (50 ON EACH ONE HUNDRED DOLLARS ($100.00) OF ASSESSED VAL- UATION, FOR MUNICIPAL PURPOSES; PROVIDING THE MANNER OF USING SUCH TAX, AND THE TIME OF COLLECTION THEREOF, AND ORDERING THE SUBMISSION OF THIS ORDINANCE TO ELECTORS OF THE CITY OF NEWPORT BEACH AT A GENERAL MUNICIPAL FIT C- TION TO BE HELD IN SAID CITY OF NEWPORT BEACH ON THE 12TH DAY OF APRIL, 1938. The City of Newport Beach, by do and through its City Council, es ordain as follows: Section 1. A tax of five cents (5c) is hereby provided for and levied in each fiscal year upon each one hundred dollars ($100.00) of assessed valuation on all prop- erty in the City of Newport Beach, which is taxable therein for municipal purposes. Section 2. The tax provided for in Section 1 of this ordinance shall be in addition to all other taxes now authorized by law to be levied. The tax collector shall compute the amount of said tax to be paid by each tax payer based upon the equalized assessed value of the property assessed to such tax payer, and said tax shall be added to the tax roll of the City of New- port Beach, and Shown upon all tax statements and tax receipts iamed by the tax collector. The time of collecting such tax and the mode and manner of levying and collecting the tax herein provided for Shall be the same as is provided for, applied to and governing in the assessment and collection of other municipal taxes in and for said City of Newport Beach. Section 3. The said tax, when collected, shall be paid into the treasury of the city of Newport Beach in the same manner and at th^ same time as all other taxes of the City of Newport Beach to the credit of the "Library Fund ", an i the money realized from said tax shall be expended for legiti- mate public library purposes in providing for and maintaining a public library in the City of New - pol t Beach. That said expendl- tures shall be made in Such man - beat, providing that all expendi- ne+ as the city council may deem tiures for said public library pur- poses shall be first submitted to and approved by the City Council, by the usual verified claim pre- sented against the City, duly nudited, and a warrant issued upon the Treasury of the City of Newport Beach, charged against said "Library Fund." Section 4. This Ordinance shall -got become effective until the vame shall have been submitted to the electors of the City of New- port Beach at a general municipal election to be held in the City of Newport Beach on the 12th day of April, 1938, and at said general municipal election there shall be snd is hereby submitted to the electors of the City of Newport Beach this ordinance, and the elec- tors of the City of Newport Beach shall be and are hereby invited to vote for or against this. ordinance, and the adoption thereof, and the °orm in which said ordinance shall se submitted to said electors as hereinbefore provided for, shall be as follows: Shall Ordinance No. !66 of the City of Newport Beach, pro- N iding for the levy and collection, for public libi ary purposes in the C i '.y of Newport Beach for each fiscal YES (608) year, of a tax of five cents (5c) on each $100.00 if the assess- ed valuation of all property kn the City of Newport Beach which is taxable there- in for municipal pur- poses, be adopted. Section 5. If at said election the majority of the votes cast on said proposition are in favor of this Ordinance and if upon can- vassing the votes so cast thereat a majority of them are found to be in favor of the Ordinance it shall become effective and said tax shall be levied and collected and used in the manner provided for herein. Section 6. ..The Clerk - of the City of Newport Beach shall not earlier than the sixtieth day nor later than twelve o'clock Noon on the twentieth day before such general municipal election, cause a notice of said general munici- pal election to be published at least once in NEWPORT NEWS, a weekly newspaper published and circulated in the City of Newport Beach, which said notice shall be headed "NOTICE OF ELECTION" and shall contain a. statement of the time of the elec- tion and the proposition to be voted upon as herein set forth, and further Shall publish a gen- eral description of the voting pre- cincts and polling places, all as required by law, and the Clerk of the City of Newport Beach shall further cause to be published, the proposition herein to be voted upon, twice in said NEWPORT NEWS, a weekly newspaper printed and published in the City of Newport Beach, all as required by law. Section 7. The above and fore- going Ordinance Shall be publish- ed once in NEWPORT NEWS, a newspaper of general circulation, printed, published and circulated in the City of Newport Beach, and Upon said publication, and being voted in favor of by a majority Of the votes cast at the election as shown by the canvass of said votes, it shall take effect and be in force. The above and foregoing ordi- nance was introduced at a regular meeting of the City Council of the City of Newport Beach held on the 7th day of February, 1938, and was finally passed and adopted on the 18th day of April, 1938, by said City Council, at an adjourned regular meeting thereof, by the following vote, to-wit: AYES, COUNCILMEN: GOR- DON, CLAIRE, W H I T S O N, BROWN, WILLIAMSON.
