HomeMy WebLinkAbout468 - Hamasi Corporation CdM Purchase• • • ORDINANCE NO. 468 WHEREAS, the Hamasi Cor- poration, a California corporation, did. on the 14th day of August, 1936, enter into a certain agree- ment or option with the City of Newport Beach, in which option or agreement the said Hamasi Cor- poration agreed to purchase from the City of Newport Beach all that certain real property situated in the City of Newport Beach, Coun- ty of Orange, State of California, and more particularly described as follows: Resubdivision of "Corona Del Mar' as shown on Map record- ed in Book 4, page 67 of Miscellaneous Maps. Records of Orange County. California. Block Lots 139 1 to 8 inclusive 139 11 to 20 inclusive 139 22 to 25 inclusive 140 1 to 5 inclusive 140 10 to 17 inclusive 140 19 140 21 to 25 inclusive 141 1 to 8 inclusive 141 10 to 25 inclusive 142 2 to 6 inclusive 142 10 to 31 inclusive 143 2 to 7 inclusive 143 10 143 12 to 16 inclusive 143 18 to 35 inclusive "Corona Del Mar" as shown on Map recorded in Book 3, pages 41 and 42 of Miscellaneous Maps. Records of Orange County, California. Z 2 Z 4 BB 2 at the prices and under the terms and conditions particularly set forth in said agreement or option, which agreement or option is now on file with the City Clerk of the City of Newport Beach where the same may be inspected by all per - ^ons interested therein: and WHEREAS, the said Hamasi Corporation has proposed an agree- ment modifying said agreement dated August 14th, 1936, in rela- tion to the properties above de- scribed, and as consideration for said modification. has agreed to cause the execution and delivery to the City of Newport Beach of a Quitclaim Deed to all of Lots 1 to 16. both inclusive. in Block "A -37" of "Corona Del Mar and that portion of Block 'B" of "Corona Del Mar" lying between the Southerly prolongation of the most Westerly side of Lot 8 in said Block "A -37" and the South- erly prolongation of the most east- erly side of Lot 1 in said Block "A -37," as shown on a Map re- corded in Book 3, pages 41 and 42 of Miscellaneous Maps, Records of Orange County, California; that said proposed agreement of modi- fication herein mentioned is on file in the office of the City Clerk of the city of Newport Beach, where the same may be inspected by all persons interested therein; and WHEREAS, it is the opinion and judgment of the City Council of the city of Newport Beach that the considerations offered by said Hamasi Corporation for the agree- ment modifying, altering and amending said Option of August 14th, 1936, is in all respects fair, just and adequate and that the best interests of the City of New- port Beach will be served by the execution and delivery of said agreement modifying, amending and altering said Option agree- ment of August 14, 1936. in rela- tion to said properties; and WHEREAS, it is likewise the opinion and judgment of the City Council of the city of Newport Beach that said proposed modify- ing agreement. as aforesaid. in relation to said property, be exe- cuted by the City of , Newport Beach, within ten days from and after the time this ordinance shall take effect.. NOW. THEREFORE, BE IT RESOLVED: That the public be notified. through publication of this ordinance. of the intention and purpose of the City Council of the city of Newport Beach to exe- cute the said agreement modify- ing, altering and amending said Hamasi Corporation agreement dated August 14th, 1936, for the considerations in said agreement mentioned, and upon the terms and conditions thereof: and BE IT FURTHER RESOLVED: That the City Clerk of the City of Newport Beach shall cause this ordinance to be published once in NEWPORT NEWS, a newspaper of general circulation. printed. pub- lished and circulated in the City of Newport Beach, and that this ordi- nance shall take effect and be in force thirty days after its passage. I hereby certify that the above and foregoing ordinance was intro- duced at an adjourned regular meeting of the City Council of the City of Newport Beach held on the 17th day of February, 1938. and was finally passed and 'adopted on the 4th day of April, 193$, by said City Council, at a regular meeting thereof, by the following vote, to -wit: AYES, COUNCILMEN: GOR- DON, CLAIRE, W H I T S O N.
