BEING AN ORDINANCE ENTITLED "ZONING ORDINANCE." The City Council of the City of Newport Beach does ordain as follows: Section 1: Section 4 of Ordinance No. 440 of the City of Newport Beach is hereby amended so as to read as follows: Section 4: R -1 (Single - Family). Residence District Regulations. (a) Uses Permitted 1— Farming. including all types of agriculture and horticulture except (a) commercial dairies. (b) commercial kennels and rab- bit-. fox -, goat - and other animal - raising farms. (c) egg - producing ranches and farms devoted to the hatching. raising. fattening and /or butchering of chickens. turkeys and other poultry on a commercial scale, (d) hog- and other live -stock feeding ranches and (e) ranches operated publicly or privately for the disposal of garbage. sewage. rubbish or offal: 2— Flower and vegetable garden- ing: 3— Nurserles and greenhouses used only for purposes of propa- gation and culture and not for retail sales; 4— Public parks. golf. swimming. tennis, polo. and country clubs: and similar recreational uses, but not including (a) yacht clubs. un- less one cf the front. back, or side boundaries of the property on which said yacht club shall be established shall extend to the high tide line of Newport Bay or of the Pacific Ocean: (b) any sport. athletic, recreational. or amusement enterprise operated as a business er for commercial pur- poses. 5— One - family dwellings of a permanent character placed in permanent locations: 6 —Home occupations. offices and studios provided no advertis- ing sign, merchandise. products or other material cr equipment Is displayed for advertising purposes; 7— Accessory buildings. uses and special uses as provided in Sec- tion 10: 6 —One (1) unlighted sign not exceeding six (6) square feet in area pertaining only to the sale. lease or hire of only the particular building. property cr premises upon which displayed. No other advertising signs. structures or devices of any character shall be permitted in any R -1 (Single - Family) Residence District: 9 —The following additional uses. subject to the issuance of conditional permits therefor as prescribed in Section 11: (a) Public- utility building: (b) Churches, museums and libraries: (c) Schools. colleges. public play- grounds and athletic fields: (d). Real estate offices. (b) Euilding- height Limit Two (2) stories and not to ex- ceed thirty -five (35) feet. except as provided in Section 10. (c) Building -site Area Required Except as provided in Sections 10 and 11. the minimum building - site area for each one - family dwelling shall be six thousand (6.000) square feet. (d) Front Yard Required Except as provided in Sections 10 and 11. no building shall be erected closer than twenty (20) feet to the front property line of the building site. (e) Side Yard Required Except as provided in Sections 10 and 11. each side yard shall be not less than five (5) feet wide. (f) Rear Yard Required . Except as provided in Sections 10 and 11, the depth of the rear yard shall be not less than twenty (20) feet.. Section 2: Section 5 of Ordinance No. 440 of the City of Newport Beach is hereby amended so as to read as follows: Section 5: R -2 (Two - Family) Residence District Regulations. (a) Uses Permitted 1 —All uses permitted in the R -1 district. but not including yacht clubs. unless one of the front, back. or side boundaries of the property on which said yacht club shall be established shall extend to the high tide line of Newport Bay or of the Pacific Ocean. 2— Two - family dwellings: (b) Building- height Limit Two (2) stories and not to exceed thirty -five (35) feet: ex- cept as provided in Section 10. (c) Building -site Area Required Except in the case of existing recorded lots having a smaller area as provided in Sections 10 and 11. the minimum building -site area shall be four thousand (4,000) square feet. but in no case shall a one or two - family dwelling be permitted which pro- vides less than . one thousand (1.000) square .feet of land area per family or housekeeping unit. (d) Front Yard Required Except as provided in Section 10. no building shall be erected closer than ten (10) feet to the front property line of the build- ing site. (e) Side Yard Required Except as provided in Sections 10 and 11. each aide yard shall have a minimum width of three (3) feet. (f) Rear Yard Required Except as provided in Section 10, no building shall be erected closer than ten (10) feet to the, rear property line of the building site. (g) Distance Between Dwellings' on Same Lot No dwelling or other main build- ing shall be closer than fifteen (15) feet to any other dwelling or main building on the same building site, and no detached ac- cessory building shall be closer than five (5) feet to any main building except as provided in Section 10. Section 3: Section 6 of Ordi- nance No. 440 of the City of New- port Beach is hereby amended so as to read as follows: Section 6: R -3 (Multiple Fam- ily) Residence District Regula- tions (a) Uses Permitted 1 —All uses permitted in the R -1 and R -2 districts. but not including yacht clubs. unless one of the front. back, or side boun- daries of the property on which said yacht club shall be established shall extend to the high tide line of Newport Bay, or of the Pacific Ocean. 2- 13ungalow- ,,'6burt9' dwelling groups. multiple - family dwellings. and apartment houses: 3— Boarding and lodging houses: 4—Lodges. fraternities and sororities: 5— Eleemosynary institutions: 6—The following uses. subject to the issuance of conditional per- mits therefor as provided in Sec - Mn 11: (a) Apartment hotels: (b) Storage garages. (b) Building - height Limit Two (2) stories and not to ex- ceed thirty -five (35) feet. except as provided in Section 10. (c) Building -site Area Required Except in the case of existing recorded lots having a smaller area as provided in Sections 10 and 11. the minimum building -site area shall be four thousand (4.000) square feet, and in no case shall a two - family dwelling or apart- ment house be permitted which provides less than six hundred (600) square feet of land area per family or housekeeping unit. (d) Front Yard Required Same as R -2 District. (See Sec- tion 5.) (e) Side Yards Required Except as provided in Sections 10 and 11. side yards not less than three (3) feet wide shall be pro- vided for all dwellings or other main buildings. (f) Rear Yard .Required Same as the R -2 District. (See Section 5.) (g) Distance between Dwellings on Same Lot No dwelling or other main building shall be closer than ten (10) feet to any other dwelling or main building on the same building site. and no detached ac- cessory building shall be closer than five (5) feet to any dwelling or main building except as pro- vided in Section 10. Section 4: Any person. firm. or corporation. whether as principal. agent. employee. or otherwise. violating any of the provisions of this ordinance shall be guilty of a misdemeanor. and upon convic- tion thereof shall be punishable by a fine of not more than Three Hundred ($300.00) Dollars or by imprisonment in the City Jail for a term not exceeding three (3) months, or by both such fine and imprisonment. Section 5: The City Clerk shall cause this ordinance to be Published once in NEWPORT BALBOA NEWS - TIMES. a news- paper of general circulation. printed. published and circulated in the City of Newport Beach. and shall take effect and be in force thirty days after its passage. The above and foregoing ordi- nance was introduced 'at a reg- ular adjourned meeting of the City Council of the City of New- port Beach held on the 19th day of June. 1939. and was finally passed and adopted on the 26th day of June. 1939. by the City Council at a regular adjourned meeting thereof, by the following roll call vote. to -wit: Ayes.
