HomeMy WebLinkAbout561 - Balboa Bayshores AnnexationORDINANCE NO. 381 AN ORDINANCE OF THE CITY OF NEWPORT BEACH AP- PROVING THE ANNEXATION OF "BALBOA BAYSHORES" TO THE CITY OF NEWPORT BEACH. WHEREAS, pursuant to Reso- lution No. 3450 of the City .Coun- ell of the City of Newport Beach, and other proceedings held and taken in accordance with the law in such cases made and provided, a special election was duly and regularly held in that certain un- incorporated territory situated in Orange County, California, known as "Balboa Bayshores" and more particularly described as follows, to -wit: PARCEL 1. All of Tract No. 1014, as shown on a map re- corded in Book 35, page 36 of miscellaneous Maps, rec- ords of Orange County, Cali- fornia, and a portion of Lot 171 in Block 54, and lands ad- joining, in Irvine's Subdivision of Ranchos San Joaquin and Lomas de Santiago and Flint and Bixby's Allotment of Ran - cho Santiago de Santa Ana, as shown on a map recorded in Book 1, page 88 of Mis- cellaneous Maps, records of Orange County, California, said portion located Souther- ly of said Tract 1014 is de- scribed as: Beginning at the most Southerly corner of said Tract 1014, said point being also a point on the U. S. Bulkhead line as established by the U. S. Engineer Office and approved by the U. S. War Department May 2, 1936; thence South 19° 52' 07" West along said bulkhead line to,, U. S. Bulkhead Station No. 130; thence .North 61° 01' 07" West along said Bulkhead line 422.11 feet; thence North 23° 51' East 144.03 feet to a point in the right of way line Of Bay Shore Drive, said point being the beginning of a curve tangent concave Northerly and having a radius of 287.50 feet; thence Northeasterly a- long said curve through a cen- tral angle of 50° 28' 20" a dis- tance of 253.26 feet to a point in the boundary of said Tract 1014, said point being the Southeasterly end of that cer- tain course North 27° 37' 04" West 306.02 feet; thence East- erly and Southeasterly along the boundary line of Tract 1014 to point of beginning. PARCEL 2. A portion of Lots 171 and 166 in Block 54, and land adjoining, of Irvine's Subdivision of Ranchos San Joaquin and Lomas de Santi- ggo and Flint and Bixby's Allotment of Rancho Santiago de Santa Ana, as shown on a map recorded in Book 1, page 88 of Miscellaneous Maps, rec- ords of Orange County, Cali - forniA, lying Northerly of State Highway ORA -60 -B de- scribed as follows: Beginning at a point of later- section of the Northerly riot of way line of the California 'State Highway ORk -604Z and the court decree line estab- lished by the Superior Court Case No. 20436; thence North 34° 57' 15" East along said court decree line 324.18 feet to Station 127; thence North 20° 01' 15" East along said court decree line 279.79 feet to Station 126; thence North 2° 31' 16" East along said court decree line 110.02 feet; thence South 720 59' 25" West 288.12 feet; thence North 88° 13' 45" West 138.63 feet; thence North 72° 59' 55" West. 143.99 feet to a point of inter- section with the easterly right Of way line of that certain county road known as Seven- teenth Street, said intersec- tion point being the beginning Of a curve tangent, concave Westerly and having a radius of 540.0 feet; thence Southerly along said curve through e central angle of 38° 55' 18" a distance of 366.33 feet to a line tangent; thence South 23° 23' 30" West 88.32 feet to the beginning of a curve tangent, concave easterly and having a radius of 360.0 feet; thence along s a i d curve through a central angle of 7° 29' 14" a distance of 47.04 feet; thence South 88° 04' 39" West 1906.29 feet; thence North 76° 10' 03" West 1146.37 feet; thence North 69° 07' 30" West 689.65 feet to a point in the Southeasterly boundary, line of Tract 919, said point bears North 39° 42' 30" East 7.55 feet from the most South- erly corner of said Tract 919, and is also a point in the line Of City limits of the City of Newport Beach; thence South 39° 42' 30" West along the said line of City Limits 7.55 feet more or less to an inter- section with the Northerly right of way line of the State Highway ORA -60 -13; thence Easterly along the said north- erly highway right of way line to the point of beginning. at which election there was sub- mitted to the qualified electors in said territory hereinabove describ• ed the following proposition, to- wit: "Shall "BALBOA BAYSHORES" be annexed to the City of New- port Beach, subject to the follow- ing conditions: (1) That said territory shall not be liable or be sub- ject to taxation topay any bonded or other indebted- ness of said City now ex- isting or incurred prior to such annexation. 1 (2) That the undedicated streets within saidterri- tory sliall not be dedicated to public use by reason of such annexation. . (3) That the sewer and water lines within said territory shall be connected with .the sewer and water. sys- tems of said City, which shall thereafter dispose of said sewage and supply water to said territory," And, WHEREAS, it appears from the canvass of the returns of 'said election so held in said ter- ritory that a majority of all the votes cast at said election therein on the question of such annexa- tion are in favor of annexation. NOW THEREFORE, the City Council of the City of Newport, Beach does ordain as follows: SECTION '1. That the annexa. tion of the unincorporated terri, tory known as "Balboa Bayshores" and hereinabove described to the City of Newport Beach hereby is approved by the City Council of said City of Newport Beach, and' said City Council of Said City c.oes hereby declare that said ter- ritory has been duly and regularly annexed to the City of Newport Beach. SECTION 2. That the C i t y Clerk of the City of Neport Beach shall cause this Ordinance to be Published once in the Newport- Balboa News- Times, a newspaper of general circulation published in said City of Newport Beach, and shall transmit to the Secre- tary of State of California, a cer- tified copy of this Ordinance, giv- ing the date of its passage, as pro- vided by law. The foregoing Ordinance was introduced at a regular meeting. of the City Council of the City of Newport Beach held on the 23rd day of June, 1947, and was, finally passed and adopted at a regular- meeting of said Council held on the 14th day of July, 1947, by fhe following vote: AYES: Allen, Siler, Isbell, Rob ertson, Reed.
