SECTION 3: Any person, fire' or corporation violating any c! the provisions of this ord'nanr shall be deemed guilty of a mis. demeanor, and upon convictior thereof shall be punishable h., fine of not more than fifty dollars ($50.00) or by imprisonment in th, City Jail of Newport Beach, or the County Jail of the County of Orange, for not exceedin, thin- (30) days, or by both such fine and imprisonment. SECTION 4: The City of the City of Newport Metal' hereby declares that this Ord; nance is enacted in the exercise of its police powers. That there is an emergency existing and that this Ordinance is necessary for the immediate preservation of the public peace, health and safety within the meaning of Section 1 of Article 4 of the Constitution of the State of California, and Sub. division C of Section 1651 of the Election Code of the Stat- of California, and shall tak, effeel immediately after its adoption. The facts constituting the emer- gency are as follows: That the City of Newport Beach has no or. dinance governing fire works of any name, character or descrip. tion at the p.'esent time; that large portions of the City of Newport Beach are very closely built ill and many of the buildings are constructed of wood and other in- flammable materials; that there is also at th, present time a scar- city of water in the City of New. po7t Beach with which to combat and fight fires and large confla. grations: that the handling, ;;se or firing of firecrackers would constitute a fire menace insofar as the City of Newport Beach is concerned at this time by *eason of the aforesaid. It is therefore imperative that an ordinance be passed at this time prohibiting fireworks within the incorporated limits of the City of Newport Beach. SECTION 5: The City Clerk shall certify to the separate vote on the urgency of this ordinance and its passage by the vote of five members of the r ty Council of the City of Newport Beach, and cause, the same to be published once in the NEW -ORT- BALBOA NEWS- TIMES, a newspaper of gene -a] circulation printed, pub, lishrd and circulated in the Citi of Nrcvport Beach, and upon adop- tion this ordinance shall become immediately operative and take fill] effect. I hereby certify that the ques- tion of the urgency of the eorego- ing ordinance was passed and the foregoing ordinance was adopted by a vote of five members of the City Council of the City of New- port Beach at its meeting held the 28th day of June. 1948.
