HomeMy WebLinkAbout677 - Boats & VesselsI • u • " 1 " Ordinance No. 677 AN - ORDINANCE AMENDING SECTIONS 10116, 10151 and 10208 OF THE MUNICIPAL CODE OF THE CITY OF NEW- PORT BEACH, AND ADDING SE CTIONS 10117.1, 10151.1, 10171, 10172, 10173 & 10174 THERETO, PROVIDING FOR THE DESIGNATION OF BOAT PARKING AREAS, REGULAT= ING THE LAUNCHING OF SMALL BOATS, REGULATING STRAY BOATS AND VESSELS, CONFERRING P O W E R ON T HE HARBOR MASTER TO TARE POSSESSION OF UN- REGISTERED VESSELS, PRO - HHATING SWIMMING IN THE MAIN CHANNEL, PRO- HIBITING OPERATION OF CERTAIN C R A F T IN THE MAIN CHANNEL, CONFER- RING POWER ON THE HAR- BOR MASTER TO MAKE TEM- PORARY R U L E S AND RE- STRICTIONS ON THE MOVE - MENT OF TRAFFIC AND RE- QUIRING S I G N S ON CER- TAIN VESSELS+ The City Council of City of Newport Beach does hereby or- dain as follows: SECTION 1: Section 10116 of the Municipal Code of the City of N e w p o r t Beach is hereby amended to read as follows: "Section 10116. Stray vessels. All stray vessels, skiffs, rowboats, dinghys, timber or other articles found within Newport Harbor not in the lawful possession or control of some person, shall be immedi- ately delivered up to the Harbor Master, in whose custody they shall remain until claimed by the proper owners, who shall pay all expenses incurred by the Harbor Master, in connection therewith, including a charge for keeping and storing the same, and if said ves- sels, timbers or other articles are not claimed within thirty d a y s from the taking of possession thereof by the Harbor Master and the charges paid as herein pro- vided for, the Harbor Master may proceed to sell said property and the proceeds of such sale shall be paid into the treasury of the City." SECTION 2. Section 10151 of the Municipal Code of the City of Newport Beach is hereby amended to read as follows: "Section 10151. Same. Refuse on Shore Lines. No person shall allow vessels, boats, materials, garbage, refuse, timber or waste matter of any description to re- main on or upon the shore lines of the Pacific Ocean, or on the shore lines of Newport Harbor, within the jurisdiction of the City; pro- vided however, t h at vessels or boats may be kept upon the shore lines of the following areas: (1) The area lying between the 15th Street public pier and the northerly prolongation of the east line of 15th Street, in which area boats and vessels may be kept only by persons owning moorings in that certain mooring area desig- nated as A -2 on U. S. Coast & Geodetic Survey Chart No. 5106: (2) The area lying between the northerly prolongation of the east line and the west line of Fernando Street, in which area boats and vessels may be kept only by per- sons owning moorings in that cer- tain mooring area designated as A -7 on U. S. Coast & Geodetic Survey Chart No. 5108; (3) The a r e a between the northerly prolongation of the east and west lines of 18th street, in which area boats and vessels may be kept only by persons owning moorings in that certain mooring area designated as B -1 on U. S. Coast & Geodetic Survey Chart' No. 5108." SECTION 3: Section 10208 of the Municipal Code of the City of Newport Beach is hereby amended'' to read as follows: "Section 10208. If the owner or person in charge or control of a ,,cssel shall not have registered the same with the Harbor Master on or before October 8, 1951, for the year 1951, or on or before June 15 of each succeeding year for said calendar year, then the Harbor Master may take immediate pos- session and custody of any such vessel, and immediately shall give notice in writing of such delin- quency to the owner or person in charge or control of said vessel, if the name is known, or, if the name mf lrnnwn h. ehn11 nncf main channel or entrance channel of Newport Harbor.
