Ordinance. No. 679
AN ORDINANCE PROIDBITING,
SLEEPING IN AUTOMOBILES
•
AND ON BEACHES
The City Council of the City _
of Newport Beach does ordain as
follows:
SECTION 1: There is hereby „
added to the Municipal Code of
the City of Newport Beach Sec-
tion 4235, to read as follows:
"Section 4235. Sleeping In auto-
mobiles or on beaches.
It is hereby declared unlawful
for any person to sleep in any
automobile parked anyplace in the
City of Newport Beach, or to sleep
on any beach, public or private,
between the hours of 9:00 P. M.
of one day and 9:00 A. M. of the,
next day.
SECTION 2: This ordinance is
hereby declared to be an emer-
gency ordinance necessary for the
Immediate preservation of the
public peace, health and safety,
and shall take effect immediately.
The following is a statement of
the facts showing its urgency.
There is at present no ordinace
or section of the Municipal Code
prohibiting sleeping in automobiles
-
or on public beaches.
Starting in the month of March,
1953, there will be a large influx

lodging in usual structures. Past
experience has shown that said
large number of visitors, particu-
larly during "Easter Week," sleep
in automobiles or on beaches to
the detriment of public peace,
health, safety and morals. It is
felt that Section 1 of this Ordi-
nance would prevent such detri-

ment to the public peace, health,
safety and morals.
SECTION 3: This ordinance
shall be published at least once in
the Newport Harbor Ensign, a
newspaper of general circulation,
printed and published in the City
of Newport Beach, and shall be in
force and effect immediately upon,
the final passage thereof.
The above and foregoing ordi-
nance was introduced at a regular
meeting of the City Council of

the City of Newport Beach, held
on the 26th day of January 1953,
and was f i n a I I y passe and
adopted on the 9th day of Febru-
ary, 1953, by the following vote,
to wit:
AYES, Councilmen: Smith,
Isbell, Miller '
NOES, Councilmen: None
ABSENT Councilmen:
Finch, Bennett
