IQLE VI AND CH.Api TER 2, ARTICLE VI OF THE A &ICIPAL CODE OF THE CITY OF NEWPORT BPh.AILK AS MORE PAR- TICULARLY SETFORTH IN 9AJD.iORDINANCE. The City Council of the City of Newport Beach does ordain as follows: SECTION 1: Section 6109 of Chapter 1 of Article VI of the Municipal Code of the City of Newport Beath be, ar4k1he same is hereby amended to read as follows: "Section 6109. 'Dancing Academy' is a place where dancing is taught and a fee is paid for such instruction." SECTION 2: That Section 6113 of Chapter 1 of Article VI of the Municipal Code of the City of Newport Beach entitled "Gen - Igral Contractor" .be, and the same is hereby, amended as follows: "Section 6113. 'General Contractor' is' a person, other than a :dubcpntractor as herein defined, who enters into a contract to c6.tfstruct or repaid buildings or structures, or any part thereof in the City for a- contract price or for a percentage of its costs, where the value of any such construction or repair when completed or the contract price thereof shall be $50.00 or more. "'Subcontractor' is a person who shall enter into a contract with a general contractor to construct or repair any portion of a building or structure, when the contract price thereof shall be $50.00 or more. For the. purposes of this Section, any person who shall commence the erection, construction or repair of any por. tion of a building or structure, when the value of said erection, construction or repair shall be $50.00 or more, shall be deemed a subcontractor, as herein defined and shall be liable to pay the license herein provided for unless the owner of said building or: structure or the owner of the land upon which such buliding or structure is being erected, constructed or repaired shall first make a sworn statement that he is erecting, constructing or repairing a portion of such building or structure as the owner then . - that he has.not. entered into a contract either verbal or Ni with' any contractor or subcontractor, or any person wh to erect, construct, or repair any portion of said building ure and that a portion of said building or structure is be" ted,. constructed or repaired by day labor at a stipulated,. said] wage to be specified in said statment), and further that ek- ing such representations in order that said person wfl avei to pay the license fees herein provided for and that ew?X, f said representations are true. h "For the purposes of this Section, every person who mall com- mence the erection or construction of any building or structure, or shall repair in any manner any building or structure, in the City, shall be deemed a contractor as herein defined and shall be liable to pay 'the license hereinafter provided for, providing that the l contract price or the value of said structure or building when completed shall be more than $50.00, unless the owner of said' building or structure, or the owner of the land on which such building or structure is being erected, constructed or repaired, shall first make a sworn statement that he is erecting, construct - ing,or repairing such building or structure as the owner thereof, and that he has not entered into a contract either verbal or writ -' ten, with any contractor or subcontractor, or any person whatso- ever, to erect or construct or repair said building or structure, and that said building or structure is being erected or constructed or repaired by day labor at a,stipulated wage (said wage to be speci- fied in said statement) and further that he is making such repre- sentatiorls in order that said person will not have to pay the li- cense fees herein provided for and that each of said representa- tions are true. "A general contractor engaging in or conducting other busi- nesses. otherwise subject to the payment of a separate business license fee as provided in this Code, shall pay the same fee for each such business as otherwise provided in this Code." SECTION 3: That Section 6126 of Chapter 1 of Article VI of the Municipal Code of the City of Newport Beach entitled "Li- cense Regtlh'ed" be, 'and the same is hereby, amended as follows:: "Section' 6126. License Required. No person, other than those specifically excepted by law, shall operate any business specified in this Code, in the City, without first having obtained'a license .from said City to do so or without complying with any and all regulatons of such business contained in this Code; and the car- rying on of such business without first having obtained a license 'from said City to do so, 'or without complying with any and all regulations of such business contained in this Code, shall consti- tute a separate violation of this Code for each and every day that such business is so carried on. "Any, business which operates another business or businesses not ordinarily an accepted part of such business otherwise sub- ject to the payment of a separate business license fee shall pay the additional license. fee for each such additional business as otherwise prescribed in this Code." SECTION 4: That Section 6129 of Chapter 1 of Article VI of the Municipal Code of the City of Newport Beach entitled "Issu- ance of License" be, and the same is hereby, amended as follows: " Section 6129. Issuance of License.
