AN ORDINANCE OF THE
CITY OF NEWPORT BEACH
DLSAPPROVING THE AN-
NEXATION TO THE CITY OF
NEWPORT BEACH OF CER-
TAIN UNINHABITED TER-
RITORY CONTIGUOUS TO
THE CITY OF NEWPORT
BEACH AND KNOWN AS
"FIRST ADDITION TO RES-
ERVOIR ANNEX."
WHEREAS, pursuant to the
provisions of an act of the Legis-
lature of the State of California,
known as the "Annexation of
Uninhabited Territory Act of
1939 ", the City of Newport Beach
instituted proceedings for the en.
nexation of certain uninhabited
territory contiguous to the City
of Newport Beach and designated
as "First Addition to Reservoir
Annex ", and which is hereinafter
more particularly described; and
WHEREAS, the City Council of
the City of Newport Beach by
Resolution No. 4914 set Tuesday,
the 24th day of February, 1959,
at the hour of 7:30 P.M. at the
City Council Chambers City Hall,
3300 Newport Boulevard, Newport
Beach, California, as the time
and place that said City Council
would hear protests to the pro-
posed annexation of said terri-
tory to the City of Newport
Beach by any person owning
real property within the said ter-
ritory; and
WHEREAS, the City Council of
the City of Newport Beach has
determined in accordance with
the Annexation of Uninhabited
Territory Act of 1939 that The
Irvine Company is the owner of
the real property in the aforesaid
territory proposed to be annexed;
and
WHEREAS, The Irvine Compa-
ny, the owner of the real prop-
erty in the said uninhabited ter.

consent with the City Clerk of
the City of Newport Beach
whereby it consented to the an.
nexation of said First Addition
to Reservoir Annex to the City
of Newport Reach and that the
-property in said territory be sub-
jected to,taxation after annexa-

WHEREAS, although no pro.
tests were made by the owners
of property at the time set for
hearing protests or at the time
to which the hearing was con-
tinued, it now appears to be in
the interest of the City of New.
port Beach and its citizens and
in the public interest that the
annexation known as the "First
Addition to Reservoir Annex" be
disapproved;
NOW, THEREFORE, the City
Council of the City of Newport
Beach does ordain as follows:
SECTION 1: The annexation
to the City of Newport Beach,
California, of that certain unin.
habited territory contiguous to
said city, known as "First Addi-
tion to Reservoir Annex ", is
hereby disapproved, and the
same is not annexed and is not
made a part of the City of New-
port Beach, California. Said ter -
itory is particularly described as
follows:
Beginning at a point of in-
tersection of the westerly
right of way line of MacAr-
thur Boulevard, 100'in width,
as described in deed, record-
ed in Book 1047, Page 557, of-
ficial records of Orange
County, California, and a
line lying northeasterly of,
parallel to and distant 1020
feet from the northeasterly
line of Block 56, and Block
92, of the Irvine Subdivision
recorded in Miscellaneous
Record Maps, Book 1, Page
88, records of said Orange
County, said point being in
the boundary line of the City
of Newport Beach; thence
southeasterly along said par-
allel line to an intersection
with a line lying northwest-
erly of, parallel to and distant
700 feet from the southeaster-
ly line of Block 91 and Block
92 of said Irvine Subdivision-
thence southwesterly along
said parallel line to an inter-
section with the northwest
and southeast center line of
said Block 92; thence South
45° 19' 59" West along a line
lying northwesterly of and
parallel to the southeasterly
line of a Metropolitan Water
District easement recorded in
Book 1211, Page 317, official
records of said Orange Coun-
ty, a distance of 2325 feet,
more or less; thence South
44° 40' 01" East to an inter-
section with the southeaster-
ly line of the aforementioned
Metropolitan Water District
easement; thence North 50°
25'59" East along said south.

1997.80 feet to an intersec-
tion with a line lying south-
westerly of, parallel to and
distant 100 feet from the

from the northeasterly line
of said Block 92 and said
Block 56; thence northwester-
ly along said parallel line
to a point of intersection
with the westerly right of
way line of the aforemen-
tioned MacArthur Boulevard;
said point also being in the
boundary of the City of New-
port Beach; thence southerly
along said right of way line
and said city boundary line,
to the point of beginning.
SECTION 2: The proceedings
herein ordained are taken under
and pursuant to the provisions
of an act of the Legislature of the
State of California, designated
and referred to as the "Annexa-
tion of Uninhabited Territory Act
of 1939 ".
SECTION 3: This Ordinance
shall be published once in the
Newport Harbor Ensign, a news-
paper of general circulation,
printed and published in the City
of Newport Beach, and the same
shall be effective 30 days after
the date of its adoption.
This Ordinance was introduced
at a regular meeting of the City
Council of the City of Newport
Beach held on the 9th day of
March, 1959, and was adopted on
the 23rd day of March, 1959, by
the following vote to wit:

LORENZ. SOMERS. KINGSLEY,
ATKINSON, HIGBIE, STODDARD.
NOES, COUNCILMEN: NONE.
ABSENT, COUNCILMEN: NONE.
