AN ORDINANCE OF THE CITY
OF NEWPORT BEACH RE-
PEALING CHAPTER 8 OF AR-
TICLE IX OF THE NEWPORT
BEACH MUNICIPAL C O D E
AND ADDING SECTION 9109.5
TO SAID CODE RELATING TO
THE INTERPRETATION AND
APPLICATION OF THE PRO-
VISIONS OF ARTICLE IX
The City Council of the City
of Newport Beach does ordain as
follows:
SECTION 1. Chapter 8 of Ar-
ticle IX of the Newport Beach
Municipal Code is repealed.
SECTION 2. Section 9109.5 is
added to the Newport Beach
Municipal Code to read:
"SECTION 9109.5. INTER-
PRETATION. When inter-
preting and applying the
provisions of this Article,
they shall be held to be
the minimum requirements
adopted for the promotion of
the public health, safety,
comfort, convenience and
general welfare. It is not
intended by the adoption of
this Article to repeal or in
any way to impair or inter-
fere with any existing pro.
vision of law of the Munici-
pal Code of the City of
Newport Beach, or any rules,
regulations or permits previ.
ously adopted or issued or
which shall be adopted or
issued pursuant to law
relating to the erection,
construction, establishment,
moving, alteration or
enlargement of any legal
building or improvement;
nor is it intended by this
Article to interfere with or
annul any easement, cove-
nant, or other agreeement
between parties; provided,
however, that in cases in
which this Article imposes
greater restrictions than are
imposed or required by other
provisions of law or the Mu-
nicipal Code of the City of
Newport Beach, or by such
rules, regulations or permits
or by such easements, cove-
nants or agreements, then in
such cases the provisions of
this Article shall control."
SECTION 3. This ordinance
shall be published once in the
official newspaper of the City,
and the same shall be effective
30 days after the date of its
adoption.
This ordinance was introduced
at an adjourned regular meeting
of the City Council of the City
of Newport Beach held on the
6th day of March, 1961, and was
adopted on the 27th day of
March, 1961, by the following.
