HomeMy WebLinkAbout955 - Planned Residential Developments.0 E ORDINANCE NO. 955 AN ORDINANCE OF THE CITY OF NEWPORT BEACH ADDING CHAPTER 8 TO AR- TICLE IX OF THE NEWPORT BEACH MUNICIPAL CODE RE- LATING TO PLANNED RESI- DENTIAL DEVELOPMENTS The City Council of the City of Newport Beach does ordain as follows: SECTION 1. Chapter 8 is add- ed to Article IX of the Newport Beach Municipal Code to read: "CHAPTER 8. PLANNED RESI- DENTIAL DEVELOPMENTS SECTION 9108.1. Planned Res- idential Development. A planned residential devel- opment is a development planned and designed as a unit to produce an environment of stable, desirable character not out of harmony with its surrounding neighborhood and which meets standards of densi- ty, open space, light and air, pe- destrian and vehicular access, and traffic circulation similar to the regulations of this Article for the 'R' District or Districts in which such development is to be located. SECTION 9108.2. Use Permit Required. (a) Planned residential devel- opments may be permitted in any 'R' District when a Use Per• mit is first secured for each such development. Such Use Permit shall be subject to the regula. tions and requirements of this chapter and notwithstanding the provisions of Chapter 6 shall be processed in accordance with the terms of this section. (b) Any application for a Use Permit under the provisions of this chapter shall be accompa- nied by a fee of Five Hundred Dollars ($500) if the land area of the proposed development is five (5) acres or less plus One Hundred Dollars ($100) for each acre or portion of an acre in e9cess of five (5) acres. (c) Such application shall be processed by the Planning Com- mission and transmitted to the City Council with a recommenda• tion for its approval or disap- proval and any conditions the Planning Commission feels should be imposed. The City Council may approve, disapprove or refer the same back to the Planning Commission for further processing. Any such permit is subject to the final approval of the City Council. SECTION 9108.3. Land Area Required. A planned residential develop. ment shall have sufficient land area to meet the objectives set forth in Section 9108;1. SECTION 9108.4. Dwelling Types and Uses Permissible. (a) Only single - family dwell. ings, and accessory uses and buildings normally incidental thereto, shall be permitted in an R -1 District. (b) Only single-family dwell- ings, two - family or duplex dwellings, or any combination thereof, and accessory uses and buildings normally incidental thereto, shall be permitted in R•2 Districts. (c) Only single - family dwell. ings, two - family or duplex dwellings, multiple or apartment dwellings, or any combination thereof as approved by the Plan- ning Commission, and accessory uses and buildings normally in- cidental thereto, shall be permit. ted in an R -3 or R•4 District. (d) Community centers, social halls, lodges, clubs, private recreation centers, churches, schools, yacht clubs, and parks and playgrounds may be permit- ted in a planned residential de- velopment in any 'R' District. All uses or buildings other than those specified herein shall be prohibited. SECTION 91095. Perimeter of Public Streets; Partial Waiver. (a) A planned residential de• velopment shall be bounded on all sides by public streets. (b) A partial waiver of this requirement may be permitted ORDINANCE 955 — PAGE 1 0 0 J 11 when it is found and determined that such partial waiver will not be inconsistent with adequate standards of pedestrian and ve- hicular access and traffic circu- lation for the development and for the area in which the de- velopment is located. SECTION 9108.6. Conformance to Master Plan. All planned residential devel- opments shall conform to the Master Plan of the City of Newport Beach, and no such de- velopment shall be approved unless such development does conform to the Master Plan. SECTION 9108.7. M a x i m u m Building Coverage. The maximum building cover. age for the development shall not exceed forty per cent (40 %) of the land area being developed, exclusive of land area being set aside for street rights -of -way. SECTION 9108.8. Minimum Land Area per Dwelling Unit. The minimum land area for each family dwelling unit, ex- clusive of land area being set aside for street rights -of -way, shall be not less than that re- quired for the district or districts in which such development is to be located. SECTION 9108.9. Minimum Floor Living Area per Dwelling Unit. There shall be a minimum floor living area of one thousand (1,000) square feet for each family dwelling unit In an R -1 or R -2 District, and there shall be a minimum floor living area of six hundred (600) square feet for each family dwelling unit in an R -3 or R -4 District. Garage space shall not be included in measur. ing this requirement. SECTION 9108.10. Maximum Building Heights. The maximum building heights shall be designated in the Use Permit but shall in no -event exceed those building heights prescribed in the district - or' districts in which such de- velopment is to be located. SECTION 9108.11. Yards and Open Spaces. The front and rear yards and open spaces between buildings shall be designated in the Use Permit. SECTION 9108.12. Off - Street Parking. The off - street parking require. ments for each such develop- ment shall be as follows: (1) Two (2) covered parking spaces for each family dwelling unit in the development. (2) There shall also be re. quired for visitors and guests at least one (1) parking space for every two (2) family dwell. ing units in the development. Such parking spaces may be un- covered and shall be so located as to be accessible to such vis. itors and guests. The require. ment for this additional parking may be waived when it is determined that there will be sufficient parking space to ade. quately serve the development without it. (3) The required parking spaces or any portion thereof may be grouped when it is found and determined that such group. ing of parking spaces and the location thereof will be acces- sible and useful in connection with the proposed dwelling units in the development. SECTION 9108.13. Use Permit Application. An application for a planned residential development shall be in the form of an application for Use Permit and shall be ac. companied by the following information, maps and plans: (1) A boundary survey map of the real property; a tentative subdivision map may be substi. tuted if the applicant proposes to subdivide the property. (2) Topography of the devel- opment area and the proposed finished grade shown in con- tour intervals of not to exceed two (2) feet upon request of the Planning Department. (3) The gross land area of ORDINANCE 955 — PAGE 2 9 the development, the present zoning classification thereof, and the zoning classification and land use of the area surrounding the proposed development, in- cluding the location of structures and other improvements. (4) A general development plan with at least the following details shown to scale and di• mensioned: a. Location of each existing and each proposed structure in the development area, the use or uses to be contained therein, the number of stories, gross building and floor areas, approximate location of entrances and loading points thereof. b. All streets, curb cuts, driving lanes, parking areas, loading areas, public transpor- tation points, and illumination facilities for the same. C. All pedestrian walks, malls and open areas for the use of occupants and mem. bers of the public. d. Location and height of all walls, fences, and screen planting, including a detailed plan for the landscaping of the development and the method by which such landscaping is to be accomplished. e. Types of surfacing, such as paving, turfing or gravel to be used at the various loca- tions. f. A grading plan of the area. (5) Plans and elevations of one or more structures to indi- cate architectural type and con- struction standards. (6) A verified petition for a change in zoning classification in accordance with Section 9106.5, if such a change in zoning clas- sification is required to make such development conform to the Master Plan. • (7) Such other information as may be required by the City to assist in the consideration of the proposed development. SECTION 9108.14. Reports from Fire and Public Works De- partments. The application and accompa• nying information, maps, and plans shall be submitted to the Fire Department and Public Works Department and written recommendations in connection therewith shall be supplied by those departments before final action is taken on such develop- ment. SECTION 9108.15. Building Permits. The Department of Building and Safety shall insure that a planned residential development is undertaken and completed in conformance with the approved plans and the terms and condi. tions of the Use Permit for such development. No building per. mit shall be issued for any con- struction or development which does not conform to such plans, terms, and conditions." SECTION 2. This ordinance shall be published once in the official newspaper of the City, and the same shall be effective 30 days after the date of its adoption. This ordinance was introduced at an adjourned regular meeting of the City Council of the City of Newport Beach held on the 20th day of March, 1961, and was adopted on the 10th day of April, 1961, by the following vote, to wit: AYES, COUNCILMEN: Kingsley, Atkinson, Cook, Stoddard, Hart, Lorenz, Som. ers.
