ING TO SUBDIVISIONS The City Council of the City of Newport Beach does ordain as follows: SECTION 1. Section 9256.14 of the Newport Beach Municipal Code is amend- ed to read: "SECTION 9256.14. (a) To assure that the design of a Planned residential development being subdivided will be Permanent unless resubdivided or re- verted to acreage according to law, the Owner or owners of the real Property being subdivided shall convey the un- derlying tee to all Public street and alley rights-ot -way to the City and shall covenant in connection therewith that the men space or recreational area lots shall be continuously main- tained for the exclusive use and benefit of Occupants of the family dwelling units in the subdivision and that access and automobile storage shall be Pro- Aged, as required by Section 9256.12: Provided, however, where more than one final map Is approved on an area where a use Permit for a Planned residential development has been ap- Proved, or where final maps are ap- proved on areas where use Permits for adlacent Planned residential devel. opments have been approved. It may be Provided with the approval of the City Council that the open space or recreational area loft within such sub- divisions shall be continuously main- tained for the use and benefit of the occupants of all or a designated Portion of the family dwelling units in all such subdivisions. Such covenants shall be approved as to form and content by the City Attorney, shall run with the real Property in the subdivision for the benefit of the loft occupied or which may lawfully be Occupied by family dwelling units in the subdivi- sion and the Public street and alley rights -m -way conveyed to the City in tee, and shall be recorded in the office of the County Recorder. SECTION 2. The amendment to Section 9256.14 enacted by this ordinance shall apply to any final tract map approved by the City Council after January 1, 7964. SECTION 3.
