'ad Car Clerk of the yCify of Newport Beach, State of California ORDINANCE NO. 1130 AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING SEC - T10N 9103.1 bF ARTICLE IX OF THE NEWPORT BEACH MUNICIPAL CODE RELATING TO PLANNING AND ZON. ING The City Council of the City at New. Fort Beach does ordain as follows: SECTION 1. Section 9109.1 of the New. port Beach Municipal Cade Is amended to react: "SECTION 9105.1. Uses; (a) No circus, carnival, amusement park, fun zone, open air theatre, race ra illr a shaic shll or ae similar estab l ment e be es- tablished in any district unless and un- til a Use Permit Is first securetl for me establishment, maintenance antl 0P- Oration of such use. (b) NO dance hall, road house, night club, commercial club, or any estab- lishment where liquor is served, or commercial place of amusement or rec- reation Or any such place or any other Place where entertainers are Provided, whether as social companions or other. wise, shall be established in any dis- trict closer than two hundred (400) feet to the boundary of any dwelling dis- trict, unless a Use Permit shall first have been Secured for the establish. ment maintenance and operation of such use. (c) Accessory uses and buildings in any 'C' or 'M' District are permitted where such uses or buildings are inc)- dental to and do not alter the charac- ter Of the premises in respect to their use for purposes Permitted in the dis- trict. Such accessory buildings shall be allowed only when constructed concur. rent with or subsequent to the main building. (d) Accessory uses normally a part of any use permitted in any 'R' District may be permitted. This shall not be construed as Permitting any commer- cial use in any 'R' District unless such is specified in the regulations for the anuma unng Or Processing o/ any substance or commodity for Profit Or the storage of vehicles, equip- ment or materials used in the conduct of any retail or wholesale business. (e) Parking Of automobiles on the roof of a building may be periditted in any 'C' or M' District, subject to first se- curing a Use Permit. - Parking of auto- mobiles on the roof Of a building in any 'R' District Is not Permitted. (f) Public or no fee private parking lots for automobiles may be Permitted In any R' District adjacent to any 'C' or 'M' District, subject to first se- curing a Use Permit in each case. (h) The removal of earthen materials may be permitted in any district, sub. ject to first securing a Use Permit In each case. (No permit required for normal grading or landscaping on lots of record.) (i) No helicopter shall land or take off and no heliport or helistop shall be established in any 'R -7' Or 'R -4' Dis- trict. In any district other than 'R -1' or 'R&, no helicopter shall land or take off and no heliport or helistap shall be established unless a Use Per. mit shall first have been secured for the establishment, maintenance, and op- eration of such use. The Planning Director may approve temporary helistops In any zoning dis- trict of the City for a period not to exceed 90 days for use in connection with major construction sites If he de- termines that such helistops will not unduly interfere with the health, safety and welfare of Persons owning property in the surrounding area and he may attach appropriate conditions to such approval. (1) The Planning Director may ap- prove temporary signs to advertise a subdivision and temporary tract or real estate offices for sales In new subdivi. Sion for a period not to exceed one (1) Year following the date of approval of the final map. The Planning Director may approve temporary structures for the housing of tools and equipment or supervisory offices for a Period not to exceed one (1) year in connection with major con- struction during the Progress Of such construction. The Planning Director may approve an extension of Periods of time specified In this subsection." SECTION 4.
