HomeMy WebLinkAbout1205 - Restaurants in Commercial Zonese THS:mec 2/8/67 ORDINANCE NO. `8(j b AN ORDINANCE OF THE CITY OF NEWPORT BEACH REPEALING ORDINANCES NOS. 1174 AND 1199 WHICH ESTABLISHED CERTAIN INTERIM ZONING REGULATIONS PROHIBITING OUT- DOOR RESTAURANTS AND DRIVE IN OR TAKE OUT RESTAURANTS IN COMMERCIAL ZONES WHEREAS, on December 27, 1966, the City Council adopted Ordinance No. 1199, an emergency ordinance which extended the restrictions relating to the acceptance of applications for and issuance of building permits for any outdoor restaurant or drive in or take out restaurant as set forth in Ordinance No. 1174 until April 24, 1967, or until the City Council repealed said ordinance; and WHEREAS, on February 14, 1967, the Council adopted Ordi- nance No. 1202 which provides for permanent zoning regulations applicable to drive in, take out, and outdoor restaurants; and WHEREAS, said permanent zoning regulations, which will become effective on March 17, 1967, will eliminate the need for • said interim zoning regulations; NOW, THEREFORE, the City Council of the City of Newport Beach does ordain as follows: repealed. SECTION 1. Ordinances Nos. 1174 and 1199 are hereby SECTION 2. By the enactment of this ordinance, it is the intention of the City Council that the zoning regulations ap- plicable to drive in, take out, and outdoor restaurants established by Ordinance No. 1202 shall be controlling as of the effective date of said ordinance, and that Ordinances Nos. 1174 and 1199 shall have no further force and effect on and after said date. SECTION 3. This ordinance shall be published once in the official newspaper of the City, and the same shall be effec- tive 30 days after the date of its adoption. • This ordinance was introduced at a regular meeting of the City Council of the City of Newport Beach held on the day of February, 1967, and was adopted on the 27,_­_'a day of 0 0 1967, by the following vote, to wit* AYES, COUNCILMEN- NOES, COUNCILMEN: ABSENT COUNCILMEN: Z�cn-' ATTEST: City rk Mayor 2.
