HomeMy WebLinkAbout1597 - Ordinance Violation Constitutes InfractionORDINANCE NO. 1597 AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING SECTION 1.04.010 OF THE NEWPORT BEACH MUNICIPAL CODE AND ADDING SECTION 1.04.050 PROVIDING THAT A VIOLATION OF CERTAIN ORDINANCES CONSTITUTES AN INFRACTION • The City Council of the City of Newport Beach DOES ORDAIN as follows: SECTION 1. Section 1.04.010 of the Newport Beach Municipal Code is amended in its entirety to read as follows: "1.04.010 Violation A Misdemeanor - Infraction - Penalty. It shall be unlawful for any person to violate any provision or to fail to comply with any requirement of this Code. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this Code shall be guilty of a misdemeanor; provided, however, any person violating any of the provisions or failing to comply with any of the mandatory requirements • of this Code shall be guilty of an infraction if said act or omission is declared to be an infraction by an ordinance of this City. Any person convicted of a misdemeanor under the provisions of this Code shall be punishable, except where a different penalty is specifically prescribed, by a fine, of not more than Five Hundred Dollars ($500.00), or by imprisonment in the City or County Jail for a period not to exceed six (6) months, or by both such fine and imprison- ment. Any person convicted of an infraction under the provisions of this Code shall be punishable by (1) a fine not exceeding Fifty Dollars ($50.00) for a first violation; (2) a fine not exceeding One Hundred Dollars ($100.00) for a second violation of the same ordinance within one (1) year; (3) a fine not exceeding Two Hundred Fifty Dollars ($250.00) for each additional violation of the same ordinance within one (1) year. -1- Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of this Code is committed, continued or permitted by such person, and shall be punishable accordingly." SECTION 2. Section 1.04.050 is added to the Newport Beach Municipal Code to read as follows: "1.04.050 Parking Violation - Infraction. Any person violating any provision of Sections 12.12.010 or 12.12.040, Chapter 12.40, Chapter 12.44, except Sections 12.44.130 and 12.44.140, or Chapter 12.48 of the Newport Beach Municipal Code shall be guilty of an infraction." SECTION 3.
