HomeMy WebLinkAbout1713 - Balboa Island Bridge Maximum Weight Limit• • is ORDINANCE NO. 1713 AN ORDINANCE OF THE CITY OF NEWPORT BEACH ESTABLISHING A MAXIMUM WEIGHT LIMIT FOR THE BALBOA ISLAND BRIDGE FOR A PERIOD OF NINETY DAYS AND DECLARING THE ORDINANCE TO BE NECESSARY AS AN EMERGENCY MEASURE TAKING EFFECT ON THE DAY IT IS INTRODUCED AND ADOPTED The City Council of the City of Newport Beach DOES ORDAIN as follows: SECTION 1. A maximum weight limit of 16,000 pounds 'per axle or set of tandem axles is hereby established for the Balboa Island Bridge. Said maximum weight limit shall be in effect for ninety (90) days from the date of introduction and adoption of this Ordinance, unless sooner repealed by the City Council. SECTION 2. The City Council of the City of Newport Beach finds that the Balboa Island Bridge is in a dangerous and weak condition and that it is necessary to limit the maximum weight on said bridge, as provided in Section 1 of this Ordinance, to maintain the structural integrity and usability of the bridge, during the period in which the bridge structure will be repaired and strenghtened. This Ordinance is adopted pursuant to and under the authority of California Vehicle Code Section 35754. SECTION 3. The City Council finds and declares that it is necessary to adopt this Ordinance as an emergency measure to preserve the public peace, health or safety to establish, on an emergency basis, a maximum weight limit for the Balboa Island Bridge to protect the bridge from failing and, conceivably, from collapsing into Newport Harbor. It is further found that any delay in the effective implementation of a weight limit could lead to structural failure of the bridge, and therefore, this Ordinance is found to be an urgency measure, to be effective upon its introduction and adoption. SECTION 4. This Ordinance shall be published once in the official newspaper of the City.
