AN ORDINANCE OF THE CITY OF NEWPORT BEACH
AMENDING SECTION 14.12.090 OF THE NEWPORT
BEACH MUNICIPAL CODE TO ADD AN EMERGENCY
SURCHARGE OF TEN PERCENT (10%) TO THE CITY'S
WATER QUANTITY RATE AND A FIFTY PERCENT
(50 %) SURCHARGE FOR QUANTITY RATES FOR WATER
USED FOR GRADING PURPOSES TO ENCOURAGE
CONSERVATION OF WATER AND TO OFFSET THE PENALTY
CHARGES IMPOSED BY THE METROPOLITAN WATER
DISTRICT, DECLARING THE ORDINANCE TO BE AN
EMERGENCY ORDINANCE TO TAKE EFFECT IMMEDIATELY
UPON ADOPTION TO PRESERVE THE PUBLIC PEACE,
HEALTH OR SAFETY, TO REMAIN IN EFFECT UNTIL
THE METROPOLITAN WATER DISTRICT HAS DETERMINED
THAT THE CURRENT DROUGHT HAS ENDED, BUT IN
ANY EVENT, NOT BEFORE DECEMBER 31, 1977
The City Council of the City of Newport Beach DOES
ORDAIN as follows:
SECTION 1. Section 14.12.090 of the Newport Beach
Municipal Code is amended to read:
"14.12.090 Quantity Charges. In addition to
the readiness to serve charges set forth in this Chapter,
the rate for water supplied to consumers through a meter,
other than pursuant to a written contract approved by
the City Council, shall be as follows:
For First 100,000 Cubic Over 100,000 Cubic

There is hereby added an emergency surcharge of ten
percent (10 %) to the quantity charges, effective April 11, 1977,
to continue in effect until the Metropolitan Water District
has determined that the current drought has ended, but in any
event not before December 31, 1977. In addition to the .
surcharge established by this section, an additional fifty
percent (50%) surcharge shall be added to the quantity
charges set forth in this chapter for water used for grading

purposes. Said surcharge for grading water shall remain
in effect until the Metropolitan Water District has
determined that the drought has ended, but in any event,
not before December 31, 1977."
SECTION 2. The City Council finds and declares that
it is necessary to adopt this ordinance as an emergency measure
to preserve the public peace, health and safety for the reason
that California is experiencing a drought of unprecedented
magnitude and that to preserve the public health and safety,
water consumption must be reduced by at least ten percent�(10 %)
to insure a continued supply of water to the City. It is further
found that the Metropolitan Water District has established
penalty.charges to be paid by member.agencies, effective April 1,
1977 to reduce consumption of water by not less than ten
percent (10 %). It is further found that a surcharge of ten percent
(10 %) by the City on all quantity rates will be needed to offset
the increased cost of water acquisition by the City due to the
penalty imposed by the Metropolitan Water District. It is further
found that a surcharge of fifty percent (50 %) for water used
for grading purposes is necessary to encourage water conservation
in grading projects, where large quantities of water are consumed.
Therefore, this ordinance is found to be an emergency measure,
to be effective upon its introduction and adoption, to preserve
the public peace, health and safety.
SECTION 3. This ordinance shall be published once
in the official newspaper of the City.
This Ordinance was introduced and adopted as an emergency
ordinance at a regular meeting of the City Council of the City
of Newport Beach held on the 11th day of April , 1977 by the
following vote, to wit:
