• AN ORDINANCE OF THE CITY OF NEWPORT BEACH
AMENDING CHAPTER 6.04 OF THE NEWPORT BEACH
MUNICIPAL CODE TO DEFINE AND ESTABLISH
REQUIREMENTS OF COMMERCIAL REFUSE BINS
The City Council of the City of Newport Beach DOES
ORDAIN as follows:
SECTION 1. Chapter 6 .04 of the Newport Beach
Municipal Code is amended to add Section 6.025 thereto, which
shall read as follows:
116.04.025 Commercial Refuse Bins Defined.
Shall mean any container, which requires
special collection equipment, and is
designed for the storage of garbage or
refuse generated by any business which
cooks or prepares food or sells food
which is not fully wrapped or packaged."
SECTION 2. Chapter 6 .04 of the Newport Beach
Municipal Code is amended to add Section 6 04.095 thereto, which
• shall read as follows:
116.04.095 Commercial Refuse Bin
Requirements. Any business which utilizes
commercial refuse bins for the storage of
garbage or refuse shall equip the bin
with a lid or cover sufficient to prevent
(1) odor from escaping the container; (2)
flies and other insects from coming into
contact with the contents of the
container; (3) the contents from leaving
the interior of the container; and (4)
rain or water from entering the interior
of the container. Further, any business
utilizing any commercial refuse bins
shall ensure that the garbage and refuse
accumulated in the bins is picked up and
disposed of at least once per week and
shall maintain each bin in a clean and
sanitary manner."
SECTION 3. This Ordinance shall be published once in
the official newspaper of the City, and the same shall be
effective thirty (30) days after the date of its adoption.
