HomeMy WebLinkAbout85-1 - Amending the Provisions of Sections 20.13.040, 20.14.040, 20.15.0409 20.16.045 and 20.17.045 Regarding Setbacks in Residential ZonesORD I NANCE NO. 85 -1 AN URGENCY ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING THE PROVISIONS OF SECTIONS 20.13.040, 20.14.040, 20.15.0409 20.16.045 AND 20.17.045 REGARDING SETBACKS IN RESIDENTIAL ZONES SECTION 1. This ordinance is declared by the City Council to be necessary as an emergency measure for preserving public peace, health and safety. This ordinance is necessary to preserve public views and open space along and across the property bordering on Upper and Lower Newport Bay. The preservation of setbacks and open space within areas previously designated by the Council are a critical component of the City's overall land use plan. SECTION 2. Chapter 20.13 of the Newport Beach Municipal Code is amended to read as follows: • 20.13.040 Yards. A. FRONT YARDS. The minimum width required for front yards shall be 20 ft. and a maximum permitted shall be 35 ft., except as may be otherwise indicated on the Districting Maps. Distances shown on the Districting Maps are to be measured from the front property line, unless a different line is shown on the Districting Map. SECTION 3. Chapter 20.14 of the Newport Beach Municipal Code is amended to read as follows: 20.14.040 Yards. A. FRONT YARDS. The minimum width required for front yards shall be 20 ft. and a maximum permitted shall be 35 ft., except as may otherwise be indicated on the Districting Maps. Distances shown on the Districting Maps are to be measured from the front lot line, unless a different line is shown on the Districting Map. • SECTION 4. Distances shown on the Districting Maps are to be measured from the front property line, unless a different line is shown on the Districting Map. • For residential developments in those areas of the City known generally as West Newport, Balboa Peninsula and Corona del Mar, front yard open space requirements are as specified in Section 20.11.040 of Residential Development Standards. SECTION 6. Chapter 20.17 of the Newport Beach Municipal Code is amended to read as follows: 20.17.045 Yards. A. FRONT YARDS. The minimum width required for front yards shall be 20 ft. and a maximum permitted shall be 35 ft., except as may be otherwise indicated on the Districting Maps. Distances shown on the Districting Maps are to be measured from the front property line, unless a different line is shown on the Districting Map. For residential developments in those areas of the City • known generally as West Newport, Balboa Peninsula and Corona del Mar, front yard open space requirements are as specified in Section 20.11.040 of Residential Development Standards. q This Ordinance is declared by the City Council to be necessary as an emergency measure for preserving the public • peace, health, safety and welfare for the reasons stated herein and shall take effect immediately. This Ordinance shall be published once in the official newspaper of the City of Newport Beach.
