HomeMy WebLinkAbout86-19 - Amending Chapter 5.50 of the Newport Beach Municipal Code Pertaining to Massage EstablishmentsORDINANCE NO. 86 -19 AN ORDINANCE'OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING CHAPTER 5.50 OF THE NEWPORT BEACH MUNICIPAL CODE PERTAINING TO • MASSAGE ESTABLISHMENTS. THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: Section 5.50.025(2) of the Newport Beach Municipal Code is hereby amended to read as follows: Any person that will be directly engaged or employed in the massage establishment, has been convicted of any offense involving the sale of a controlled substance specified in the Health and Safety Code Section 11054, 11055, 11056, 11057, or 11058 or the possession for sale and /or possession of a controlled substance specified in the Health and Safety Code Section 11054, 11055, 11056, 11057 or 11058 in the massage establishment or has been • convicted in any other state of any offense which, if committed or attempted in this state, would have been punishable as one or more of the above mentioned offenses. SECTION 2: Section 5.50.040(2) of the Newport Beach Municipal Code is hereby amended to read as follows: The applicant has been convicted of any offense involving the sale, of a controlled substance specified in Health and Safety Code Sections 11054, 11055, 11056, 11057, or 11058, or the possession for sale and /or possession of a controlled substance specified in the Health and Safety Code Section 11054, 11055, 11056, 11057 or 11058 in the massage establishment or has been convicted in any • other state of any offense which, if committed or -1- 0 attempted in this state, would have been punishable as one or more of the above mentioned offenses. SECTION 3: All other sections of Chapter 5.50 of the Newport Beach Municipal Code pertaining to massage establishments • shall remain the same and continue in full force and effect. SECTION 4: The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. The City Clerk shall cause the same to be published once in the official newspaper within fifteen (15) days after its adoption. The Ordinance shall become effective thirty (30) days from its adoption.
