HomeMy WebLinkAbout90-30 - Amending Title 20 of the Municipal Code Establishing the Residential Overlay District (Planning Commission Amendment No. 709)ORDINANCE NO.-90-30 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING TITLE 20 OF THE MUNICIPAL CODE ESTABLISHING THE RESIDENTIAL OVERLAY DISTRICT (Planning Commission Amendment No. 709) • WHEREAS, Zoning Amendment No. 709 is intended to implement the commercial /residential mixed use provisions of the adopted Land Use Element of the General Plan; and WHEREAS, at its meeting of May 10, 1990, the Planning Commission scheduled Zoning Amendment No. 709 for public hearing at the Planning Commission meeting of June 7, 1990; and WHEREAS, the public was duly noticed of the public hearing; and WHEREAS, on June 7, 1990, the Planning Commission of the City of Newport Beach held a public hearing regarding Amendment No. 709 and voted to recommend approval of the amendment; and •WHEREAS, on July 9, 1990, the City Council of the City of Newport Beach held a public hearing regarding the amendment; and WHEREAS, the public was duly noticed of the public hearing. NOW THEREFORE, the City Council of the City of Newport Beach does hereby ordain as follows: SECTION 1. Chapter 20.37 is hereby added to the Newport Beach Municipal Code to read as follows: CHAPTER 20.37 RESIDENTIAL OVERLAY ( -R) DISTRICT • 20.37.010 Intent and Purpose 20.37.020 Uses Permitted 20.37.030 Development Standards 20.37.010 INTENT AND PURPOSE. It is the intent and purpose of this chapter to provide for the establishment of residential uses in commercial districts and to regulate such residential uses through application of the Residential Overlay ( -R) District. 1 20.37.020 USES PERMITTED A. All uses which would be provided under ordinances governing the primary commercial district shall be permitted. B. Residential uses shall be permitted on the second floor or above, where the ground floor is occupied by a use permitted under ordinances governing the primary commercial district. •20.37.030 DEVELOPMENT STANDARDS A. LOT AREA PER UNIT. One dwelling unit shall be permitted for each 2,375 square feet of land area, with a minimum of one dwelling unit allowed per lot, unless otherwise indicated on the Districting Maps. For purposes of determining the allowable number of units, areas which have a slope greater than two to one (2:1) or which are submerged shall be excluded from land area. Submerged areas are defined to be areas which are below Mean Higher High Water. B. FLOOR AREA RATIO AND BUILDING BULK. 1. The total gross floor area and building bulk in all structures on any site shall be as specified in Chapter 20.07. 2. The residential portion of the structure, excluding covered parking, shall be limited to a maximum floor area ratio of .75. C. SETBACKS. Setbacks shall be as specified on the Districting Maps or district standards for the underlying commercial district, except that a rear yard setback area of ten feet shall be required on the second floor for residential uses. D. HEIGHT. Building height shall be as specified in Chapter 20.02. •E. OFF - STREET PARKING REQUIRED. Off - street parking for nonresidential uses shall be provided in accordance with standards governing the underlying commercial district, except that up to two tandem parking spaces may be provided for non - residential uses where less than four off - street parking spaces are required for non - residential uses. In addition to parking required for commercial uses, a minimum of two offstreet parking spaces shall be provided for each dwelling unit, of which at least one space per dwelling unit shall be covered and at least one space per dwelling unit shall be independently accessible. Parking for the residential use shall be provided on -site with no exceptions. SECTION 2. Section 20.01.045 of the Newport Beach Municipal Code shall be amended to read as follows: 20.01.045 SPECIAL DISTRICTS DESIGNATED. In addition to the general districts established above, the following special districts are established which, when combined with the above general districts, establish additional special regulations: Combining or " -B" District. Combining or " -H" District. Combining or " -Z" District. Planned Residential Development. Mobile Home Park or " -MHP" Overlay District. • Site Plan Review or " -SPR" Overlay District. Residential or " -R" Overlay District SECTION 3. The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. This Ordinance shall be published once in the official newspaper of the City within fifteen (15) days of its adoption.
