HomeMy WebLinkAbout92-19 - Amending Chapter 15.06 Newport Beach Municipal Code to Adopt the National Electrical Code, 1991 EditionORDINANCE NO. 92- 19 AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING CHAPTER 15.06 NEWPORT BEACH MUNICIPAL CODE TO ADOPT THE NATIONAL ELECTRICAL CODE, 1991 EDITION The City Council of the City of Newport Beach DOES ORDAIN as follows: •SECTION 1. Chapter 15.06 of the Newport Beach Municipal Code is adopted to read: Chapter 15.06 ELECTRICAL CODE Sections: 15.06.010 Adoption of The National Electrical Code. 15.06.020 Amendment to Article 90 -4. 15.06.030 Addition of Article 90 -9. 15.06.040 Amendment to Article 110 -5. 15.06.050 Amendment to Article 210 -1. 15.06.060 Amendment to Article 250- 91(b). 15.06.070 Amendment to Article 345 -3(b). 15.06.080 Amendment to Article 346 -1(c). 15.06.090 Amendment to Article 348 -1. 15.06.100 Amendment to Article 350.5. • 15.06.010 Adoption of the National Electrical Code. The City Council adopts and incorporates by reference, as though set forth in full in this Chapter, the 1990 edition of the "National Electrical Code" as published by the National Fire Protection Association International Conference, subject to the changes and modifications set forth in this chapter. The City Council also adopts and incorporates by reference all applicable portions of Title 24, California Code of Regulations subject to the changes, and modifications set forth in this chapter. The various parts of this code, along with the additions, amendments and deletions adopted in this Chapter, shall constitute and be known as the Newport Beach "Electrical" Code. A copy of the 1990 National Electrical Code, printed . in code book form shall be kept on file in the office of the City Clerk. 15.06.020 Amendment to Article 90 -4. Article 90 -4 of the Electrical Code is amended to read: 90 -4 Enforcement. The Building Official of the City of Newport Beach shall enforce the provisions of this code and shall have the responsibility for making interpretations of the rules, for deciding upon the approval of equipment and 1 materials, and for granting the special permission contemplated in a number of the rules. All administrative provisions including permit process, fees and inspections for this chapter are contained in the Administrative Code under Chapter 15.02. 15.06.030 Addition of Article 90 -9. Article 90 -9 is added to the • Electrical Code to read: 90 -9 Electrical Inspector. Electrical Inspector shall be the Building Official of the City of Newport Beach and such other person or persons in the Building Department as are authorized and directed by the Building Official to carry out under his /her direction and supervision the powers and duties set forth in this Code. Whenever the term "Electrical Inspector" is used in any section of this ordinance such term shall be construed to mean the Building Official or his /her authorized representative. 15.06.040 Amendment to Article 110 -5. Article 110 -5 of the Electrical Code is amended to read: 110 -5 - Conductors normally used to carry current shall be of copper, •except that conductor sizes of #6AWG and larger may be of aluminum. To install smaller than #6 AWG aluminum conductors, all termination points must have continuous inspection by a special inspector approved pursuant to Section 15.02.040 of this Code. Where the conductor materials are not specified, the sizes given in this code shall apply to copper conductors. Where other materials are used, the size shall be changed accordingly. For aluminum and copper clad aluminum conductors, see tables 310 -16 through 310 -19 of this code. 15.06.050 Amendment to Article 210 -1. Article 210 -1 of the National Electrical Code is amended to read: 210 -1 Scope. The provisions of this Article shall apply to branch circuits supplying lighting or appliance loads or combinations of such loads. Where motors, or motor - operated appliances, are connected to any circuit • supplying lighting or other appliance loads, the provisions of both this Article and Article 430 shall apply. Article 430 shall apply where branch circuit supplies only motor loads. N Accessory uses or other buildings, signs, etc., separately located on the same lot or premises shall have connecting conductors run underground. (Agricultural areas excepted.) Where spare circuit protective devices are provided or space for future circuit protective devices is provided on the buss in any flush or semi -flush •mounted panel, then raceways of sufficient capacity to permit utilization of such space or spaces shall be provided to an approved accessible location. Such accessible location is defined as follows: Where sufficient attic or underfloor space is available, a raceway shall terminate conveniently for future use in each such space. Where this condition does not exist, then such terminations shall be approved by the Electrical Inspector. 15.06.060 Amendment to Article 250- 91(b). Article 250 -91(b) of the Electrical Code amended to read: EXCEPTION NO. 1: No flexible metal conduit shall be permitted for grounding. 15.06.070 Amendment to Article 345 -3(b). Article 345 -3(b) of the National Electrical Code is amended to read: •345 -3(b) Intermediate metal conduit, elbows, couplings, and fittings shall be permitted in concrete or in above ground areas subject to severe corrosion when provided with corrosion protection judged suitable for the condition. (FPN): See Section 300 -6 for protection against corrosion. 15.06.080 Amendment to Article 346 -1(c). Article 346 -1(c) of the National Electrical Code is amended to read: 346 -1(c) - Ferrous or nonferrous metal conduit, elbows, couplings, and fittings shall be permitted to be installed in concrete, or in areas subject to severe corrosion when provided with corrosion protection judged suitable for the condition. (FPN): See Section 300 -6 for protection against corrosion. 15.06.090 Amendment to Article 348 -1. Article 348 -1 of the Electrical Code is amended to read: • 348 -1 Use - Electrical metallic tubing may be used for both exposed and concealed work inside of structures. Electrical metallic tubing shall not be installed in a manner which will cause it to be exposed to the outside air or weather conditions. Electrical metallic tubing protected from corrosion solely by enamel shall not be used. Electrical metallic tubing shall not be used (1) where during installation or afterwards, it will be subject to severe physical 3 damage; (2) for installation underground. Where practical, the use of dissimilar metals throughout the system shall be avoided to eliminate the possibility of galvanic action. (See Article 300 -6 for limitation in the use of ferrous raceways and fittings protected from corrosion solely by enamel.)" 15.06.100 Amendment to Article 350 -5. Article 350 -5 of the National • Electrical Code is amended to read: 350 -5 Grounding. Flexible metal conduit shall not be permitted as a grounding means. SECTION 2. That if any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentence, clauses and phrases be declared unconstitutional. SECTION 3. This Ordinance shall be published once in the official newspaper of the City, and the same shall be effective thirty (30) days after the • date of its adoption.
