(Planning Commission Amendment No.757)• ORDINANCE NO. 92 -24 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING TITLE 20 OF THE MUNICIPAL CODE SO AS TO REGULATE THE OPERATION OF SHORT TERM LODGING UNITS WITHIN RESIDENTIAL ZONES. (PLANNING COMMISSION AMENDMENT NO.757) WHEREAS, Section 20.84.010 of the Municipal Code of the City of Newport Beach provides that Title 20 (the Zoning Code) may be amended by changing provisions whenever the public necessity and convenience and the public welfare require such amendment; and WHEREAS, Title 20 of the Newport Beach Municipal Code does not regulate the operation of short term lodging in residential zones; and WHEREAS, the City of Newport Beach is largely a tourist destination, with numerous lodging units that are frequently rented for short terms during the summer months; and WHEREAS, the influx of tourists in short term rental units results in many large • parties and gatherings, often resulting in undesirable disturbances, making it necessary to establish a provision for increased control of short term lodging units; and WHEREAS, The Police Department frequently responds to complaints of noise, disturbances and illegal activity at short term lodging units; and WHEREAS, most of the short term lodging occurs in residential zones, creating disturbances and adverse impacts on homeowners and long term residents; and WHEREAS, the City Council has reviewed extensive evidence and documentation attesting to the need for regulation and control of short term lodging units in residential zones; and WHEREAS, the project has been reviewed and it has been determined that it is categorically exempt from the requirements of the California Environmental Quality Act • under Class 5 (Minor Alterations in Land Use Limitations); and WHEREAS, pursuant to Section 20.84.30, the Planning Commission has held a duly noticed public hearing to consider Amendment No. 757 to Title 20 of the Newport Beach Municipal Code; and WHEREAS, the Planning Commission recommended that the City Council approve Amendment No. 757 to Title 20 of the Newport Beach Municipal Code adding Section 20.10.022; and WHEREAS, pursuant to Section 20.84.050, the City Council has held a duly noticed public hearing to consider Amendment No. 757 to Title 20 of the Newport Beach Municipal Code. • NOW, THEREFORE the City Council of the City of Newport Beach does hereby ordain as follows: SECTION 1. Section 20.10.022 of the Municipal Code is hereby added to read as follows: 20.10.022 SHORT TERM LODGING PERMITTED. Any dwelling unit otherwise permitted by this Title may be used for short term lodging purposes as defined in Chapter 5.95 of the Municipal Code subject to the securing of: • A. A Business License pursuant to Chapter 5.04 of the Municipal Code. B. A Transient Occupancy Registration Certificate pursuant to Section 3.16.060 of the Municipal Code. C. A Short Term Lodging Permit pursuant to Chapter 5.95 of the Municipal Code. SECTION 2. The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. This Ordinance shall be published once in the official newspaper of the City, and the same shall become effective thirty (30) days after the date of its • adoption. SECTION 3.
