HomeMy WebLinkAbout94-16 - Amending Title 20 of the Newport Beach Municipal Code Amending Districting Map No. 18, So as to Delete the 10 Foot Front Yard Setbacks Adjacent to a Vacated Alley and Adjacent to a Vacated Portion of Glen Drive (Planning Commission Amendment No. 7ORDINANCE NO. 94 -16 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, AMENDING TITLE 20 OF THE NEWPORT BEACH MUNICIPAL CODE AMENDING DISTRICTING MAP NO. 18, SO AS TO DELETE THE 10 FOOT FRONT YARD SETBACKS ADJACENT TO A VACATED ALLEY AND ADJACENT TO • A VACATED PORTION OF GLEN DRIVE (Planning Commission Amendment No. 797) WHEREAS, Section 20.84.010 of the Municipal Code of the City of Newport Beach provides that Title 20 (the Zoning Code) may be amended by changing the zoning designation of Districts and other provisions whenever the public necessity and convenience and the public welfare require such amendment; and WHEREAS, the proposed limitation on development on the Glen Drive side of the subject property, in question, will be consistent with the setback established in conjunction with the approval of Resubdivision No. 1002; and WHEREAS, the project has been determined to be Categorically Exempt • from the provisions of the California Environmental Quality Act (CEQA) under Class 5 (Minor Alterations in Land Use Limitations); and WHEREAS, pursuant to Section 20.84.030, the Planning Commission has held a duly noticed public hearing to consider Amendment No. 797, amending a portion of Districting Map No. 18; and WHEREAS, on March 28 1994, the City Council of the City of Newport Beach held a public hearing regarding Amendment No. 797. NOW THEREFORE, the City Council of the City of Newport Beach does hereby ordain as follows: SECTION 1: The following described real property in the City of Newport Beach, County of Orange, State of California, more particularly described as, • Lots 55, 69, 70 and a portion of Lot 68, Block A, Tract No. 673, a portion of a vacated street and a portion of a vacated alley, located at 344 -352 Hazel Drive, on the southeasterly side of Hazel Drive, southeasterly of East Coast Highway, in Corona del Mar, as shown on Districting Map No. 18, referred to in Section 20.01.050 of the Newport Beach Municipal Code and by such reference made part of Title 20 of said Code, is hereby amended so as to delete the existing 10 foot front yard setbacks adjacent to the vacated alley and adjacent to the vacated Glen Drive. SECTION 2: The Planning Director of the City of Newport Beach is hereby instructed and directed to change Districting Map No. 18 referred to in Section 20.01.050 of the Newport Beach Municipal Code and by such reference made part of Title 20, to reflect the changes described in Section 1 above, and when said Districting Map has been so amended, the same shall be in full force and effect and be part of Title 20 of the • Newport Beach Municipal Code. SECTION 3: The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. This Ordinance shall be published once in the official newspaper of the City, and the same shall become effective thirty (30) days after the date of its adoption. SECTION 4. This Ordinance was introduced at a regular meeting of the City Council of the City of Newport Beach, held on the 14th day of March , 1994, and was adopted on the 28th day of March , 1994, by the following vote, to wit: AYES, COUNCIL MEMBERS HEDGES, SANSONE, WATT, TURNER, HART.
