AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF NEWPORT BEACH
AMENDING TITLE 20 OF THE NEWPORT BEACH
MUNICIPAL CODE SO AS TO AMEND CHAPTER 20.33 OF
TITLE 20 OF THE MUNICIPAL CODE TO LIMIT AUTOMOBILE
STORAGE, REPAIR, AND DETAILING USES WITHIN
THE RSC, APF AND RMC DISTRICTS
(PLANNING COMMISSION AMENDMENT NO. 833)
• WHEREAS, Section 20.84.010 of the Municipal Code of the City of Newport Beach
provides that Title 20 (the Zoning Code) may be amended by changing provisions whenever the public
necessity and convenience and the public welfare require such amendment; and
WHEREAS, the Land Use Element of the General Plan states that the purpose of
the commercial land use designations are primarily intended to provide retail, office, marine
commercial, and visitor- serving uses; and
WHEREAS, certain automotive - related uses operating independent of uses which
are retail, office, marine commercial or visitor - serving in character are inconsistent with stated
purpose of these commercial land use designations; and
WHEREAS, the Retail and Service Commercial (RSC), Administrative,
isProfessional, and Financial (APF), and Recreational and Marine Commercial (RMC) zoning
districts require amendment to limit such uses to those which are ancillary to automobile sales
uses or to the principal uses permitted within these districts; and
WHEREAS, on October 5, 1995, the Planning Commission of the City of
Newport Beach held a public hearing regarding Amendment 833; and
WHEREAS, the City Council finds that the proposed amendment is Categorically
Exempt (Class 5) from the provisions of the California Environmental Quality Act; and
WHEREAS, on January 22 , 1996, the City Council of the City of Newport
Beach held a duly noticed public hearing regarding this ordinance.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of
• Newport Beach does hereby ordain and approve Amendment No. 833 to amend Table 20.33
contained in Chapter 20.33 of Title 20 of the Newport ]Beach Municipal Code to read as follows:
SECTION 1. That a portion of Table 20.33 of the Municipal Code shall be
amended as follows:

SECTION 2. The Mayor shall sign and the City Council shall attest to the
passage of this Ordinance. This Ordinance shall be published once in the official newspaper of the City,
and the same shall become effective thirty (30) days after the date of its adoption.
SECTION 3. This Ordinance was introduced at a regular meeting of the City
Council of the City ofNewport Beach held on the 8th day of January, 1996, and was adopted on the
22nd day of January , 1996, by the following vote, to wit:
