AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AMENDING CHAPTER 12.24 OF THE
NEWPORT BEACH MUNICIPAL CODE REGARDING
INCREASING AND DECREASING STATE SPEED LIMITS
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY ORDAIN
AS FOLLOWS:
SECTION 1: Chapter 12.24 of the Newport Beach Municipal Code is amended in its
entirety to read as follows:
Section 12.24.010 Speed Regulation by Traffic Signal Timing.
The City Traffic Engineer is authorized to regulate the timing of traffic
signals so as to permit the movement of traffic in an orderly and safe
manner at speeds slightly at variance from speeds otherwise
applicable within the district or at intersections, and shall erect
appropriate signs giving notice thereof.
Section 12.24.020 Increasing State Speed Limits.
It is hereby determined upon the basis of engineering and traffic
surveys that the speed permitted by State law upon the streets or
parts thereof described in Sections 12.24.030 through 12.24.045 is
less than is necessary for safe operation of vehicles thereon by
reason of the nature of the streets, the stop signs on intersecting
streets or the wide spacing of intersections, and it is hereby
declared that the prima facie speed limit shall be as hereinafter
designated on those streets or parts thereof when signs are
erected giving notice thereof.
Section 12.24.030 Prima Facie Speed Limit —Thirty Miles Per
Hour.
The prima facie speed limit on the following named streets or parts
thereof shall be thirty (30) miles per hour:
Avocado Avenue from Waterfront Drive to East Coast Highway.
Cliff Drive from Riverside Avenue to Dover Drive.
Dover Drive East from Mariners Drive to Irvine Avenue.
Newport Boulevard from Finley Avenue to 21st Street.
Santiago Drive from Irvine Avenue to Tustin Avenue.
Westminster Avenue from Old Newport Boulevard to 15th Street.
Section 12.24.040 Prima Facie Speed Limit —Thirty -five Miles
Per Hour.
The prima facie speed limit on the following named streets or parts
thereof shall be thirty-five (35) miles per hour:
Bayside Drive from Marine Avenue to El Paseo Drive.
Dover Drive East from Westcliff Drive to Mariners Drive.
Monrovia Avenue,
Old Newport Boulevard from West Coast Highway northerly to 15th
Street.
Harbor Island Drive from Harbor Island Road to end of Street (E).
Section 12.24.045 Prima Facie Speed Limit — Forty -five Miles
Per Hour.
The prima facie speed limit on the following named streets or parts
thereof shall be forty -five (45) miles per hour:
Campus Drive.
Section 12.24.050 Decreasing State Speed Limits.
It is hereby determined upon the basis of engineering and traffic
surveys that the speed permitted by State law outside of business
and residence districts as applicable upon the streets or parts
thereof described in Sections 12.24.055 through 12.24.090 is
greater than is reasonable or safe under the conditions found to
exist upon such streets, and it is hereby declared that the prima
facie speed limit shall be as hereinafter designated on those streets
or parts thereof when signs are created giving notice thereof.
Section 12.24.052 Prima Facie Speed Limit —Sixty Miles Per
Hour.
The prima facie speed limit on the following named streets or parts
thereof shall be sixty (60) miles per hour:
Newport Coast Drive from Pacific Coast Highway to Route 73.
Section 12.24.055 Prima Facie Speed Limit—Fifty-five Miles
Per Hour.
The prima facie speed limit on the following named streets or parts
thereof shall be fifty -five (55) miles per hour:
Coast Highway from Cameo Shores Road to Newport Coast Drive.
Jamboree Road from East Coast Highway to Campus Drive.
MacArthur Boulevard from Campus Drive to Jamboree Road
MacArthur Boulevard from Route 73 to East Coast Highway
San Joaquin Hills Road from Marguerite Avenue to Newport Coast
Drive.
Section 12.24.060 Prima Facie Speed Limit —Fifty Miles Per
Hour.
The prima facie speed limit on the following named streets or parts
thereof shall be fifty (50) miles per hour:
Bison Avenue from Route 73 to MacArthur Boulevard.
Bonita Canyon Drive from MacArthur Boulevard to Route 73.
Coast Highway from Jamboree Road to Avocado Avenue.
Ford Road from Jamboree Road to MacArthur Boulevard.
Irvine Avenue from Mesa Drive to Bristol Street.
Pelican Hill Road North from Newport Coast Drive to Pelican Hill
Road South.
San Joaquin Hills Road from Jamboree Road to Marguerite
Avenue.
San Miguel Drive from San Joaquin Hills Road to Ford Road.
University Drive from Jamboree Road to East City Limit.
Section 12.24.065 Prima Facie Speed Limit —Forty-five Miles
Per Hour.
The prima facie speed limit on the following named streets or parts
thereof shall be forty -five (45) miles per hour:
Avocado Avenue from Coast Highway to San Miguel Drive.
Birch Street from Bristol Street to Jamboree Road.
Bison Avenue from MacArthur Boulevard to Jamboree Road.
Bristol Street from Jamboree Road to Campus Drive.
Campus Drive from MacArthur Boulevard to Jamboree Road.
Coast Highway from Poppy Avenue to Cameo Shores Road.
Dover Drive from West Coast Highway to Westcliff Drive.
Irvine Avenue from Santa Isabel Avenue to Mesa Drive.
Mesa Drive -Birch Street from Irvine Avenue to Bristol Street.
Newport Center Drive.
Newport Ridge Drive West from San Joaquin Hills Road to Newport
Ridge Drive East.
Pelican Hill Road South from Newport Coast Drive to Pelican Hill
Road North.
Ridge Park Road from Newport Coast Drive to End of Street East.
Santa Barbara Drive.
Vista Ridge Road."
Section 12.24.070 Prima Facie Speed Limit—Forty Miles Per
Hour.
The prima facie speed limit on the following named streets or parts
thereof shall be forty (40) miles per hour:
Bayside Drive from Coast Highway to Promontory Drive East.
Coast Highway from Avocado Avenue to Carnation Avenue.
Dove Street from Campus Drive to Bristol Street.
Eastbluff Drive North form Vista Del Sol northerly to Jamboree
Road.
Irvine Avenue from Westcliff Drive to Santiago Drive.
Marguerite Avenue from Fifth Avenue to San Joaquin Hills Road.
Placentia Avenue between Hospital Road and the north City limit.
Quail Street from Birch Street to Dove Street.
San Miguel Drive from MacArthur Boulevard to San Joaquin Hills
Road.
Spyglass Hill Road.
Superior Avenue from Coast Highway to Industrial Way.
Von Karman Avenue from MacArthur Boulevard to Campus Drive.
15th Street between Superior Avenue and Monrovia Avenue.
Newport Ridge Drive East from San Joaquin Hills Road to Newport
Ridge Drive West.
Section 12.24.075 Prima Facie Speed Limit —Thirty-five Miles
Per Hour.
The prima facie speed limit on the following named streets or parts
thereof shall be thirty -five (35) miles per hour:
Bayside Drive from Promontory Drive East to Marine Avenue.
Camelback Street.
Coast Highway from Carnation Avenue to Poppy Avenue.
Eastbluff Drive South from Vista Del Sol southerly to Jamboree
Road.
Hospital Road from Newport Boulevard to Superior Avenue.
Irvine Avenue from 16th Street to Westcliff Drive.
Irvine Avenue from Santiago Drive to Santa Isabel Avenue.
Jamboree Road from Bayside Drive to East Coast Highway.
La Salud from La Felicidad to La Vida.
Monrovia Avenue south of 16th Street to north of Production Place.
Newport Center East/West from Newport Center Drive to Newport
Center Drive.
San Clemente Drive from Santa Barbara Drive to Santa Cruz Drive.
San Miguel Drive from Newport Center Drive to MacArthur
Boulevard.
Santa Cruz Drive.
Sea Lane between Goldenrod Avenue and Harbor View Drive.
Westcliff Drive from Dover Drive to Irvine Avenue.
16th Street from Irvine Avenue to Dover Drive."
Section 12.24.080 Prima Facie Speed Limit — Thirty Miles Per
Hour.
The prima facie speed limit on the following named streets or parts
thereof shall be thirty (30) miles per hour:
Balboa Boulevard from Medina Way to 23rd Street.
Balboa Boulevard from 23rd Street to 32nd Street.
Balboa Boulevard from 32nd Street to Coast Highway.
Bayside Drive from Carnation Avenue to Marguerite Avenue.
Irvine Avenue from 15th Street to 16th Street.
Ridge Park Road from San Joaquin Hills Road to Newport Coast
Drive.
Riverside Avenue from Coast Highway to Cliff Drive.
Santa Rosa Drive.
Tustin Avenue from Santiago Avenue to 23rd Street.
Vista Del Oro.
Section 12.24.085 Prima Facie Speed Limit—Twenty-five Miles
Per Hour.
The prima facie speed limit on the following named streets or parts
thereof shall be twenty -five (25) miles per hour:
Flagship Avenue, between Placentia Avenue and Dana Road.
Newport Hills Drive East between Ford Road and Port Laurent
Place.
Newport Hills Drive West between Ford Road and Port Hemley
Circle.
Section 12.24.090 Prima Facie Speed Limit — Fifteen Miles Per
Hour.
The prima facie speed limit on the following named street or part
thereof shall be fifteen (15) miles per hour:
Back Bay Drive between Shellmaker Road and Eastbluff Drive.
SECTION 2: If any section, subsection, sentence, clause or phrase of this ordinance is,
for any reason, held to be invalid or unconstitutional, such decision shall not affect the
validity or constitutionality of the remaining portions of this ordinance. The City Council
hereby declares that it would have passed this ordinance, and each section,
subsection, clause or phrase hereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses and phrases be declared unconstitutional.
SECTION 3: The City Council finds that this ordinance is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.
SECTION 4: The Mayor shall sign and the City Clerk shall attest to the passage of this
ordinance. The City Clerk shall cause the same to be published once in the official
newspaper of the City, and it shall be effective thirty (30) days after its adoption.
SECTION 5: This ordinance was introduced at a regular meeting of the City Council of
the City of Newport Beach, held on the 11th day of January, 2011, and adopted on the
25th day of January, 2011, by the following vote, to wit:
