HomeMy WebLinkAbout10 - Declaring Its Intention to Order and Require the Construction of a Cement Sidewalk and a Cement Curb Upon and Along the East and West Sides of 23rd Street From the North Line of Ocean Avenue to the South Curb Line of Bay Avenue, Except Upon Such Por• • it �j �i copy RESOLUTION OF INTENTION NO. 10 COPY 1 A RESOLUTION of the Board of Trustees of the City of Newport Beach, declaring its intention to order 2 ii and require the construction of a cement side -walk and a cement curb upon and along the east and west sides 3 of 23rd Street from the north line of Ocean Avenue to the south curb line of Bay Avenue, except upon such 4 portions thereof where a cement side -walk and curb have already been constructed; directing the Clerk 5 to post this Resolution and to publish the same; re- quiring the posting of notices of Street Work by 6 the Superintendent of Streets and the publication of a similar notice and designating the newspaper 7 in which said publication shall be had. 8 The Board of Trustees of the City of Newport Beach do 9 hereby resolve and declare as follows: - 10 Section 1: RESOLVED: That the public interest and con - 11 venience require and that it is the intention of the Board of 12 Trustees of the City of Newport Beach to order the following stre 13 work done, namely, the construction of a cement side -walk and a 14 cement curb along and upon the east and west sides of 23rd Street 15 in the City of Newport Beach, to the official line and grade of 16 said 23rd Street (which official line and grade of said 23rd 17 Street is established by Section 4 of Ordinance Number 30 of the 18 City of Newport Beach which Ordinance Number 30 is now on file in 19 and one of the records of the Office of the Clerk of said City); 20 said cement side -walk to be constructed upon and along the east 21 and west sides of 23rd Street adjoining the property line thereof 22 and on the sidewalk reservation provided for in Sub - division 1'C" 23 I of Section 1 of Ordinance Number 24 of the City of Newport Beach 24 and shall extend from the north line of Ocean Avenue to the south 25 curb line of Bay Avenue in said City, except upon such portions i 26 jI of said 23rd Street, between the north line of Ocean Avenue and 27 + the south curb line of Bay Avenue, where a cement side -walk has, 28 I already, been constructed in accordance with the specifications 29 herein after set forth and to the official line and grade of said 30 23rd Street as established by Section Four of said Ordinance Num- 31 ber Thirty of said City. 32 -1- 1 2 1-0 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 40 29 30 31 32 COPY COPY Section 2: RESOLVED: That said cement curb be constructed along and upon the east and west sides of said 23rd Street in the City of Newport Beach from the north line of Ocean Avenue to the south curb line of Bay Avenue.and shall be constructed on the outer or street edge of the side -walk reservation on said 23rd Street provided for in Sub - division "C" of Section 1 of Ordinance Number 24 of the City of Newport Beach and shall be eight feet from and parallel with the property line of the property abutting on said east and west sides of said 23rd Street and shall extend from the north line of Ocean Avenue to the south curb line of Bay Avenue, excepting such pottions thereof where a cement curb has, already, been constructed in accordance with the specifications hereinafter set forth and to the official line and grade of said 23rd Street as established by Section 4 of Ordinance Number 30 of the City of Newport Beach. Section 3: RESOLVED: That the specifications for said side- walk and the construction thereof be and the same are as follows: (A) The earth foundation shall be filled in and tamped SOLID to such a height as when surfaced shall conform to the grade estab- lished by Section 4 of Ordinance Number 30 of the City of Newport Beach. (B) When said earth foundation shall have been so filled in and tamped the same shall be surfaced with a layer, 2 1/2 inches thick and 5 1/2 feet in width of concrete, composed of seven parts of fine clean gravel to one part of best Portland Cement, properly mixed and well tamped into place. (c) Said concrete layer shall then be surfaced with a cap of cement, 1/2 inch thick, composed of equal parts of clean, sharp sand and best Portland Cement, the same to be floated and troweled to an even and smooth surface, sloping towards the Street in the ratio of 3/16 of an inch of fall to a foot of side -walk. -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Section 5: RESOLVED: That the specifications for said cement curb shall be as follows, to -wit:- (A) The curb shall consist of a core, ten inches thick at the bottom and six inches thick at the top and fifteen inches deep and set with the batter towards the street the top when finished in a line with the sloping surface of the side -walk. (B) Such top and the upper ten inches of the batter or street face to be dressed 1/2 inch thick with cement composed of equal parts of clean, sharp sand and best Portland Cement the same to be floated and trow6led to a true, even and smooth surface. Section 6: RESOLVED: That the Clerk be and he is hereby directed to post this Resolution of Intention conspicuously for two days, on or near the door of the Council Chamber of the Board of Trustees of the City of Newport Beach and to publish the same by two insertions in the Newport News, a weekly newspaper, pub- lished and circulated in the City of Newport Beach, which Newport News is hereby designated by the Board of Trustees for that pur- pose. Section 7: RESOLVED: That the Street Superintendent shall thereupon cause to be conspicuously posted along the line of said contemplated work, not more than one hundred feet in distance apar but not less than three in all, notices of the passage of this Resolution. Said notice shall be headed "Notice of Street Work" in letters of not less than one inch in length and shall in legible characters state the fact of the passage of this Resolu- tion,-its date, and briefly the work proposed and refer to this Resolution for further particulars and whereas there is no daily newspaper published and circulated in the City of Newport Beach he shall cause a Notice similar in substance to be published by one insertion in the Newport News, a weekly newspaper, published and circulated in the City of Newport Beach, which Newport News is hereby designated for that purpose. -3- J C7 1 2 3I 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 The above and foregoing Resolution of Intention No. 10 was passed and adopted the 22nd day of June, A. D. 1908, at a regular meeting of the Board of Trustees of the City of Newport Beach, by the following vote: - AYES: C. A. Barton, Jos Ferguson, F. W. Beckwith, A. N.
