A resolution of the Board of Trustees of the City of New- port Beach ordering that certain alley in the City of Newport Beach be closed, vacated and abandoned. The Board c' Trustees of the City of Newport Beach do hereby resolve and declare as follows:- RESOLVED: That, whereas on the 5th day of October, 1908, there was passed and adopted, by the Board of Trustees of the Ci of Newport Beach, and approved by C. A. Barton, President of said Board, and attested by L. S. Wilkinson, Clerk thereof, a resolu- tion declaring it to be the intention of said Board of Trustees to order a certain alley in the City of Newport Beach, abandoned, vacated and closed, and describing the work to be done and the im provement to be made, and the land deemed necessary to be taken therefor, Specifying the exterior boundaries of the district of lands to be effected and benefited by said work or improvement and to be assessed to pay the costs and expenses thereof, direct- ing the posting or publication of notices according to law and designating the newspaper in which said publication should be made. And, whereas the Street Superintendent of the City of New- port Beach, as provided for in said resolution, ahas caused to be conspicuously posted along the line of said contemplated work or improvement, to -wit : - along the line of said alley, at not more than 300 feet in distance apart and not less than 3 in all, notices of the passage of said resolution, which notices were headed "Notice of Public Work" in letters of not less than one inch in length, which notices did, in legible characters, state the fact of the passage of said resolution, its date and briefly the work or improvement proposed, and referred to said resolution for further particulars. sG;s And, whereas the Street Superintendent has caused to be -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 29 30 31 32 and there has been published a notice similar in substance, by four successive insertions in the Newport News, a weekly newspap published and circulated in the City of Newport Beach, a weekly newspaper, which Newport News was designated for said purpose. And whereas no person or persons interested have, in writing, objected to said work or improvement or to the extent of the district of lands to be effected or benefited by said work or improvement and to be assessed to pay the costs and expenses thereof. And whereas more than ten (10) days after the expiration of the time for the publication of said notice has elapsed. NOW, THEREFORE, BE IT REoOLVEL: That the public interest and convenience require that that certain alley in the City of Newport Beach, which alley is described as follows:- Commencing at the northwest corner of Lot 16, block 7, East Newport, as per map thereof, recorded in Book 3, page 37 of Miscellaneous Maps, records of Orange County, California, running thence south 202 feet, more or less, to the southwest corner of lot 17 in block 7; thence westerly, on the north line of Surf Avenue 10 feet to the west line of an alley shown on said map; thence north 202 feet to the south line of Central Avenue; thence easterly 10 feet to the point of beginning. be vacated, abandoned and closed. RESOLVED: That the work or improvement proposed is for the closing up an alley and it appears that no assessment is ne0es and for that reason no commissioners to assess benefits and are appointed therefor. RESOLVED: That that certain alley, described as follows, to -wit: Commencing at the northwest corner of lot 16, block 7, East Newport, as per map thereof, recorded in book 3, page 37 of miscellaneous Maps, records of Orange County, California, running thence south 2C2 feet, more or less, to the southwest corner of lot 17 in block 7; thence westerly, on the north line of Surf Avenue 10 feet, to the west line of an alley shown on said map; thence north 202 feet to the south line of Central Avenue; thence easterly 10 feet to the point of beginning. be and the same is hereby closed, vacated and abandoned. The above and foregoing resolution was passed and adopted -2- 1 2, 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 at a regular meeting of the Board of Trustees of the City of New- port Beach held on the 7th day of December, 1908, by the follow- ing vote, to wit: AYES: C. A. Barton, F. w. Beckwith, J. McMillan NOES: None ABSENT: J. Ferguson, A. N. Smith The above and foregoing resolution is hereby approved this 7th day of December, 1908. C. A.
