HomeMy WebLinkAbout22-A - Vacating a Certain Alley- 1 RESOLUTION ORDERING WORK DONE, 2 No. 22-A 3 4 A resolution of the Board of Trustees of the City of Newport Beach, ordering that a certain alley inthe City of 5 Newport Beach be closed, abandoned and vacated. 6 The Board of Trustees of the City of Newport Beach do hereby 7 resolve and declare as follows: - 8 SECTION 1 :- Resolved: That, whereas on the 24th day of 9 August, A.D. 1908, at a regular meeting of the Board of Trustees 10 of the City of Newport Beach, the said Board of Trustees did 11 pass and adopt and there was, on said 24th day of August, A.D. 12 1908, approved by C. A. Barton, President of the Board of Trus- 13 tees of said City and attested by L. S. Wilkinson, Clerk of 14 said Board, a resolution declaring its intention to close, 15 abandon and vacate a certain alley in the said City of Newport 16 Beach, which resolution described the work to be done or improve - 17 ment to be made and the land deemed necessary to be taken there - 18 for, specifying the exterior boundaries of the district of lands 19 to be effected or benefited by said work or improvement and to 20 be assessed to pay the cost and expenses thereof and directing 21 the posting and publication of notice according to law and de- 22 signating the newspaper in which said publication shall be made. 23 And$, whereas the Superintendent of Streets caused to be post - 24 ed along the line of said contemplated work or improvement, at 25 not more than three hundred Peet in distance apart and not less 26 than three in all, notices of the passage of said resolution, 27 which notices were headed "Notice of Public Work" in letters of 28 not less than one inch in length, and did, in legible characters 29 state the Pact of the passage of said resolution, its date and 30 briefly the work or improvement proposedp and referred to said 31 resolution for further particulars; and, whereas, the said 32 Superintendent of Streets caused a notice similar in substance -1- r: • 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 to be published and there was published, a notice similar in sub- stances by four successive insertions in the Newport News, a weekly newspaper published and circulated in the City of Newport Beach* which Newport News was the newspaper designated for said purpose; and whereas, more than ten (10) days have elapsed after the expiration of the time for the publication of said notice; and whereas no person or persons interested in said work or im- provement, or the extent of the district of lands to be effected or benefited by said work or improvements and to be assessed to pay the cost and expenses thereof have made written objection to the same• NOW, THEREFORE, be it resolved: That the public interest and convenience require and that the Board of Trustees of the City of Newport Beach do hereby order the following street work to be done : - That that certain alley located in said City, hereinafter described, be closed, abandoned and vacated, which alley is described as follows : - Commencing in the Northwest corner of Lot 18, Block 109, thence East to the Northeast corner of Lot 1 in said Block 109; thence North twenty (20) feet; thence West to a point twenty (M) feet North of the point of beginning; thence South twenty (20) feet to the point of beginning. RESOLVED:- That said work is for closing up and it appears that no assessment is necessary,wherefore, no commissioners are appointed to assess benefits and damages. The above and foregoing Resolution No. 22 was passed and adopted the 7th day of December, A.D. 1908, at a regular meeting of the Board of Trustees of the City of Newport Beach by the following vote:- AYES: C.
