HomeMy WebLinkAbout67 - Ocean Avenue Improvements1 2 4p3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 GOFY RESOLUTION NO. 67 c ui Y A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT BEACH, DECLARING THEIR INTENTION TO IMPROVE CERTAIN PORTIONS OF OCEAN AVENUE IN THE SAID CITY, FORMING AN ASSESSMENT DISTRICT OF LANDS TO BE BENEFITTED BY AND TO PAY THE COST S AND EXPENSES OF SAID PROPOSED IMPROVEMENTS. Be it resolved by the Board of Trustees of the City of Newport Beach, as follows; SECTION ONE That the public interest and convenience require and the said Board of Trustees does hereby declare its intention to order the improvement of a portion of OCEAN AVENUE within the said City, from a line twenty -five (25) feet easterly of and parallel with the southerly prolongation of the easterly line of Twenty -third Street to the southerly prolongation of the easterly line of Thirty -Sixth StPeet, by the construction of a board walk on pile bents on that portion of said Ocean Avenue l,yi between the northerly line of said Ocean Avenue and a line twelve (12) feet southerly of and parallel with the nartherly line of said Ocean Avenue, including/ all street and alley intersections, be con- structed to official line and grade according to plans No. 100 and 101 on file in the office of the City Engineer of Newport Beach, California) and in further accordance with Specifications Numbered 26, adopted by Resolution No. 65 of the roard of Trustees of the City of Newport Beach and on file in the office of the City Clerk of said City. SECTION TWO That the said contemplated work of improvement of the portion of said Ocean A enue, is in the opihion of the said Board of Trustees of the City of Newport Beach, of more than local or ordinary public benefit and they declare that the exterior bound- aries of thelands to be benefitted by said improvement and to be assessed to pay the costs and expenses of s aid improvement shall be as follows; -1- 1 Beginning at the intersection of the southerly prolonga- 2 i tion of the center line of Thirty -Sixth Street and the southerly 3 �i line of Ocean Avenue; thence easterly along the southerly line of 4 said Ucean Avenue to a point of the intersection with the center 5 line of the Southern Pacific Railroad Company's right of way, said 6 right of way being 100 feet in width; thence north - westerly along 7 the center line of the said right of way of the Southern Pacific 8 Railroad Company to a point of the intersection with the northerly 9 prolongation of the center line of Thirty- Second Street; thence 10 southerly along the center line of said Thirty- Second Street to a 11 point of the intersection with the easterly prolongation of the 12 northerly line of Block 332 of a Map of the Canal Section, Newport 13 Beach, as recorded in Miscellaneous Maps, Book 4, page 98, Records 14 of Orange County, California; thence westerly in a straight line 15 along the northerly lines of BlockS332, 333, 334 and 335 of the 16 aforesaid map of the Canal Section, Newport Beach, to the center 17 line of Thirty -Sixth Street; thence southerly along the center line 18 of said Thirty -Sixth Street to the southerly line of Ocean Avenue, 19 the place of beginning, excepting therefrom lands'forming part of 201! any public street or alley. 2111 The total expense of all work done in constructing said 2211 improvements as described in the Resolution of Intention, shall be 23 assessed on the lots and parcels of land lying within the limits 24 of the assessment district, described in Section Two of the Reso- 25 , lution of Intention. 26 1 The City Engineer is hereby directed to make a diagram i 27 of the property affected or benefited by the proposed work of im- 40 28 provement as desXcribed above and to be assessed to pay the expense 29 thereof. Such diagram shall show each separate lot, piece or par - 30 cel of land, the area of each of said lots, pieces or parcels of 31 land and the relative locations of the same to the work proposed to 3211 be done, all within the limits of said assessment district. -2- 1 2 69 4 4 5 6 7 8 I 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 00 29 30 31 32 A plat of the said district above described has been approved by the City Council of the City of Newport Beach, which plat indicates by a boundary line the extent of the territory to be lincluded in the said assessment district, and the same is now on file in the office of the City Engineer of the said City and ref- erence to said plat is hereby made. SECTION THREE That the proceedings for the aforesaid improvement shall be had and taken under an act of the Legislature of the State of California,.entitled, "An Act to provide for work upon streets, lanes, alleys, courts, places, and sidewalks, and for the con- struction of sewers within municipalities" aprroved Marbh 18th, 1885, (Commonly known as the Vrooman Act), and under all acts sup- plementary thereto or amendatory thereof. SECTION FOUR The Street Superintendent shall cause to be conspicuous posted, notice (' the work as required by law, and shall cause said notice to be published by one insertion in the Newport News, a ly newspaper, printed, published and circulated within the said City of Newport Beach, which is hereby designated for that purpose. (There being no daily newspaper so printed, published and circulate SECTION FIVE The City Clerk shall certify to the passage of this res- olution and shall cause the same to be published by two insertions in the Newport News, a weekly newspaper, printed, published and circulated within the said City of Newport Beach, which is hereby designated for that purpose, and shall post the same conspicuously for two days on or near the door of the Council Chamber, (being the room in the City Hall, of the City of Newport Beach, in which the /said Board of Trustees hold their meetings); and immediately upon the passage of this Resolution of Intention, the said City Clerk shall give notice thereof by mailing cards to the owners of lands -3- I 1 2 3 4 5 6, I 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 4p28 29 30 31 32 to be assessed for said proposed improvement in the manner requirec by law.
