HomeMy WebLinkAbout69 - Ocean Avenue Improvementsi, 2 3 4 5 0 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 �- 29 30 31 32 n COPY RESOLUTION NO. 69 COPY A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPOR BEACH, DECLARING THEIR INTENTION TO IMPROVE CERTAIN PORTIONS OF OCEAN AVENUE IN THE SAID CITY, FORMING AN ASSESSMENT DISTRICT OF LANDS TO BE BENEFITEDD BY AND TO PAY THE COSTS AND EXPENSES OF SAI PROPOSED IMPROVEMENTS. Be it resolved by the Board of Trustees of the City of Newport Beach, as follows: SECTION ONE That the public interest and convenience require and the said Board of Trustees does hereby declare its intention to order the improvement of a portion of OCEAN AVENUE within the said City, from the southerly prolongation of the westerly line of Twenty -third Street to the southerly prolongation of the easterly line of Thirty -Sixth Street, by the construction of a Board walk on pile bents on that portion of said Ocean Avenu4 lying between the northerly line of said Ocean Avenue and a line twelve (12) feet southerly of and parallel with the northerly line of said Ocean Avenue, including all street and alley intersections be constructed to official line and grade, according to Plans No. 100 and 101 on file in the office of the City Engineer of Newport Beach, California, and in further accordance with Specifications Numbered 26, adopted by Resolution No. 65 of the Board of Trustees of the City of Newport Beach and on file in the office of the City Clerk of said City. SECTION TWO That the said contemplated work of improvement of the por- tion of said Ocean Avenue, is in the opinion of the said Board of Trustees of the City of Newport Beach, of more than local or ordir ary public benefit and they declare that the exterior boundaries of the lands to be benefited by said improvement and to be assesse to pay the costs and expenses of said improvement shall be as follows: Beginning at the intersection of the southerly prolongation -1- i • 1 2 3 4 5 0 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 of the center line of Thirty - Sixth Street and the southerly line of Ocean Avenue; thence easterly along the southerly line of said Ocean Avenue to a point of the intersection with the center line of the Southern Pacific Ralroad Company's right of way, said right of way being 100 feet in width: thence northwesterly along the center line of the said right of way of the Southern Pacific Rail- road Company to a point of the intersection with the northerly pro- longation of the center line of Thirty- Second Street; thence south- erly along the center line of said Thirty- Second Street to a point of the intersection with the easterly prolongation of the northerly line of Block 332 of a Map of the Canal Section, Newport Beach, as recorded in- Miscellaneous Maps, Book 4, page 98, Records of Orange County, California; thence westerly in a straight line along the northerly lines of Block 332, 3339 334 and 335 of the aforesaid map of the Canal Section, Newport Beach, to the center line of Thirty -Sixth Street; thence southerly along the center line of said Thirty -Sixth Street to the southerly line of Ocean Avenue, the place of beginning, excepting therefrom lands forming partof any public street or alley. The total expense of all work done-in constructing said im- provements as described in the Resolution of Intention, shall be assessed on the lots and parcels of land lying within the limits of the assessment district described in Section Two of the Resolu- tion of Intention. The City Engineer is hereby directed to make a diagram of the property affected or benefited by the proposed work of improv ment as described above and to be assessed to pay the expense thereof. Such diagram shall show each separate lot,piece or parc of land, the area of each of said lots, pieces or parcels of band and the relative locations of the same to the work proposed to be done, all within the limits of said assessment district. SECTION THREE That the proceedings for the aforesaid improvement shall be had and taken under an act of the.Legislature of the State of Cali- fornia, entitled "An Act to provide for work upon streets, lanes, alleys, courts, places, and sidewalks, and for the construction of sewers within municipalities ", approved March, 18th, 1885, (common- ly known as the Vrooman Act), and under all acts supplementary thereto or amendatory thereof. SECTION FOUR The Street Superintendent shall cause to be conspicuously posted, notice of the work as required by law, and shall cause sai notice to be published by one insertion in the Newport News, a weeklyynewspaper, printed, published and circulated within the sai City of Newport Beach, which is hereby designated for that purpose (There being no daily newspaper so printed, published and circulat SECTION FIVE The City Clerk shall certify to the passage of this resolu- tion and shall cause the same to be published by two insertions in the Newport News, a weekly newspaper, printed, published and cir- culated within the said City of Newport Beach, which is hereby designated for that purpose, and shall post the same conspicuously for two days on or near the door of the Council Chamber, (being the room in the City Hall of the City of Newport Beach, in which the said Board of Trustees hold their meetings); and immediately upon the passage of this Resolution of Intention, the said City Clerk shall give notice thereof by mailing cards to the owners of lands to be assessed for said proposed improvoent in the manner required by law. am 9 i 1 2 3 4 5 6 7 8 9 10 11 12 13 14' 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 9 Passed and approved this 20 day of February, 1917.
