OF THE CITY OF IMPROVE CERTAIN THE IMPROVEMENT ACT The Board of Trustees of the City of Newport Beach do resolve as follows: Section One. That the public interest and convenience require and it is the intention of the Board of Trustees of the City of Newport Beach to order the following work to be done: That Surf Avenue within the said City, from the westerly line of the Alley situated between Block 2 of the Newport Bay Tract as recorded in Map Book 4, page 16 of Records of Orange County, California and Block 4 of the Balboa Tract as recorded in Map Book 4, page 11 Records of Orange County, California, and the southerly prolongation of the said westerly line of said Alley to a line which is 180 feet easterly of and parallel with the easterly line of E- Street, by the construction of a board walk on wooden pile bents on that protion of said Surf Avenue lying between the northerly line of said Surf Avenue and a line twelve(12) feet southerly of and parallel with the said norhth- erly line of Surf Avenue, including all street and alley inter- sections, be constructed to official line and grade, in accord- ance with Plans No. 104 and 105 and on file in the offcie of the City Engineer of said City of Newport Beach, and in further accordance with specifications numbered 26, adopted by Resolution No.65 of the Board of Trustees of the City of i,ewport Beach and on file in the offcie,of the City Clerk of said city. Section Two. That the said contemplated work of improvement of the portion of said Surf Avenue, is in the opinion of the said Board of Trustees of the City of Newport Beach, of more than local ordinary public benefit and they declare that the exterior boundaries of the lands to be benefitted by said improvement and to be assessed to pay the costs and expenses of said improve- ment shall be as follows: jBeginning at a point, which point is at the intersection of the 11ortherly prolongation of the westerly line of Lot 5, Block 2 of a Map of the Newport Bay Tract, as recorded in Map Book 47 page 16, Records of Orange County, California and the center line of the Alley in said Block 2 of the Newport Bay Tract; thence easterly along the center line of the aforesaid alley to the intersection of said center line with the center line of the Alley situated between the aforesaid Block 2 of the Newport Bay Tract and Blcok 4 of the Balboa Tract, as recorded in Map Book4, page 11, Records of Orange County, California; thence southerly along the center line of the last mentioned alley to a point which is 1GO feet northerly of the northerly line of Surf Avenue, as said Surf Avenue is shown and laid out upon a Map of the Balboa Tract as hereinbefore described; thence easterly in a straight line 10G feet northerly of and parallel with the aforesaid northerly line of Surf Avenue to a point in the center line of A- Street; thence easterly in a straight line to the northwesterly corner of Lot 15, Block 14 of the afore- said Map of the Balbao Tract;thence easterly in a straight line to a point in the center line of B- Street, which point is 164.05 feet southerly of the center line of Central Avenue, and measured along the cneter line of the aforesaid B- Street;thence northerly along the center line of B- Street to its intersection -1- N 3 4 5 6 7 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 IL 29 30 31 32 with the center line of Central Avenue; thence easterly along the center line of Central Avenue to a point at the intersection with the northerly prolongation of the easterly line of Lot 6, Block 22 of the aforesaid Map of the Balboa Tract; thence souther along the nortbJarly prolongation of theaaforesaid easterly line of said Lot 6, and along the easterly line of said Lot 6, and the southerly prolongation of the said easterly line of said Lot 6 to its intersection with the southerly line of Surf Avenue; thence westerly along the southerly line of said Surf Avenue to the intersection of the southerly prolongation of the westerly lineof Lot 5, Block 2 of the aforesaid Map df the Newport Bay Tract; thence northerly along the southerly prolongation of the aforesaid westerly line of Lot 5, Block 2, and along the westerly line of said Lot 5,and along the northerly r.rolongation of the said westerly line of Lot 5 to its intersection with the center line of the foresaid Alley in Block 2 of the aforesaid Map of Newport Bay Tract, the place of beginning: excepting therefrom any portion of any public street or alley. Section Three. The City Engineer is hereby directed to make a diagram of the property affected or benefitted by the proposed work or improve- ment as described in this Resolution of Intention, and to be assessed to pay the expenses thereof, said diagram to be made as required by law. Section Four The said Board of Trustees determines that serial bonds shall be issued to represent each assessment of $25.00 or more for the costs of said work or improvement; said serial bonds shall extend over a period of nine years from the 2nd day of January next succeeding the date of said bonds and shall bear interest at the rate of seven per centum per annum, and an even annual proportion of the principal sum thereof shall be payable by coupon on the 2nd. day of January of each year after theft date until the whole is paid, and the interest shall be payable semi- annually by coupon on the second days of January and July respect- ively of each year at the rate of seven per centum per annum on all sums unpaid until the whole of said principal and interest have been paid. Section Five It is hereby determined and notice is hereby given that any and all persons having an objection to the proposed work or improvement above mentioned, mmy appear before the said Board of Trustees on the 7th day of January, 1918, at the hour of 7:30 P.M. of said day at the regular meeting place of said Board of Trustees in the City Hall of said City of Newport Leach, and show cause why said proposed improvement should not be carried out in accordance with this resolution. Section Six All of the rpoceedings for for the issuance of said bonds accordance with the provisions tiie State of California, known ment Act of 191111, and all acts the aforesaid improvement and shall be taken under and in of an Act of the Legislature of and designated as the "Improve - amendatory thereof. -2- 1 E 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 q 31 32 Section Seven The City Clerk shall certify to the passage of this Resolu- tion and sahll cause the same to be published twice in-he Newport News, a weekly newspaper, printed, published and circulated in the said City of Newport Beach, and which is hereby designated for that purpose. Passed by the Board of Trustees of the City of Newport Beach at their regular meeting held on the 3rd.day of December, 1917, and appovved by the '-resident of said Board this 3rd day of December. 1917.
