HomeMy WebLinkAbout136 - Construction of Sanitary Sewers1 • 2 • 3 4 is 5 • • • 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 COPY COPY RESOLUTION NO. 136 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT BEACH ORDERING THE CONSTRUCTION OF CERTAIN CEMENT PIPE SANITARY SEWERS, A REINFORCED CONCRETE SEPTIC TANK, REINFORCED CONCRETE PUMPING STATIONS, A SLUDGE BED AND APPURTENANCES IN THE CITY OF NEWPORT BEACH, DETERMINING THAT BONDS BE ISSUED TO REPRESENT THE COST THEREOF, AND DECLARING THE WORK OR IMPORVEMENT TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND THAT THE EXPENSE OF SAID WORK OR IMPORVEMENT SHALL BE ASSESSED UPON A DISTRICT. The Board of Trustees of the City of Newport Beach do resolve as follows: SECTION ONE. That said Board of Trustees of said City of Newport Beach deems it to be required by the public interest and convenience and hereby orders that all of the cement pipe sanitary sewers described in Resolution No. 133;of said Board of Trustees adopted July 6, 1920, being the Resolution of Intention for the construction of said sewer, together with all of the appurtenances thereto, the concrete septic tank, the reinforced concrete pumping station therein designated No. 1, the sludge bed, the reinforced concrete pumping station therein designated as pumping station No. 2, the reinforced concrete pumping station therein designated as pumping station No. 3, together with all building, equipment and appurtenances for the said work mentioned or described in said Resolution No. 133, be constructed. The said Resolution No. 133 is hereby referred to for a description of the said work or improvement and is hereby expressly adopted and made a part of this resolution, the same as though fully set forth herein. SECTION TWO. 'hat the aforesaid work or improvement in the opinion of the said Board of Trustees is of more than local or ordinary public benefit and said Board of Trustees determines that the district which it, in Resolution of Intention declared to be the district -1- • • 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 • 28 • 29 30 • 31 32 to be assessed to pay the costs and expenses of said work is the district within said City of Newport Beach benefited by said work or improvement and to be assessed to pay the costs and expenses thereof. Reference is hereby made to said Resol= ution of Intention No. 133 for a description of the said assess- ment district. SECTION THREE." Notice is hereby given that serial bonds represent unpaid assessments, and bear interest at the rate of seven per cent per annum will be issued hereunder in the manner provided by the "Improvement Bond Act" of 1915, the last installment of which bonds shall mature fourteen years form the second day of July next succeeding nine months from their date. SECTION FOUR. the City Engineer shall make a diagram of the property benefited or affected by said work or improvement and to be assessed to pay the expneses thereof. Such diagram shall show each separate lot, piece or parcel of land, the area in square feet of said lots, pieces or parcels of land, and the relative location of the same to the work or improvement ordered to be done, all within the limits of the assessment district. SECTION FIVE. 'hat the proceedings for the aforesaid improvement shall be had and taken under an act of the Legislature of the State of California entitled "An Act to provide for work upon streets, lanes, alleys, courts, places and sidewalks and for the construc tion of sewers within municipAlities ", approved March 18, 1885, (commonly known as the Vrooman Act), and under all acts supple- mentary thereto or amendatory thereof. That the said bonds shall be issued under an act of the Legislature of the State of California entitles "An Act to provide for the issuance of -2- 1 • 2 • 3 4 • 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 • 28 • 29 30 • 31 32 improvement bonds to represent and be secureddby certain assessments made for the costs of certain work and improvement made in and upon streets, avenues, lanes, alleys, courts, places and sidewalks within municipalities, and upon property and rights of way owned by municipalities, to provide for the collection of such assessments, the sale of the property affected thereby and for the payment of the bonds so issued ". Approved June 11, 1915,( commonly known as the Improvement Bond Act of 1915), and under all acts supplementary thereto or amendatory thereof. Section Six. The Clerk of said City shall publish notice of said work of improvement inviting sealed proposala or bids for doing said work or improvement, and referring to the specifications posted and on file by two insertions in the Newport News, a weekly newspaper, printed, published and circulated within said City of Newport Beach, which said newspaper is hereby designated for said purpose, and he shall also post the said notice with specifications conspicuously for five days on or near the chamber door of the Council and shall require in said notice a certified check or a bond as prescribed b y law, and for an amount not less than ten per cent of the aggregate of said proposal. The time fixed in said notice for the opening of bids shall be at the hour of 7:30 P.M. of Monday the 11th day of October, 1920. SECTION SEVEN.
