HomeMy WebLinkAbout151 - Sale of Bonds for Newport Bay Truning BasinRESOLUTION NO. 151 1 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT BRACH AS THE LEGISLATIVE BRANCH THEREOF, PROVIDING FOR THE SALE OF CERTAIN MUNICIPAL • 2 BONDS OF MUNICIPAL IMPROVEMENT DISTRICT NO. 1 OF THE CITY OF NEWPORT BEACH THEREOF AT PRIVATE SALE. 3 4 WHEREAS, at a special election held at and within Municipal improvement 5 District No. 1 of the City of Newport Beach on the 7th day of June, 1921, 6 there was submitted to the qualified electors of said District the proposition 7 of incurring a bonded indebtedness is the sum of $12,500.00 for the construc- 8 tion of a truning basin in Newport Bay; and 9 10 WHEREAS, two hirds and more of all the voters voting at said special 11 election voted in favor of incurring such indebtedness and issuing the bonds 12 of said District in the City of Newport Beach in the sum of $12,500.00 for 13 that purpose; and !�rAZREAS, on the 20th day of June, 1921, the Board of Trustees of the City 14 15 of Newport Beach pas -ed and adopted Resolttion No. 142, providing, among other 16 things, for the issueance and sale of said bonds at public sale after ad- 17 vertisement for bids therefor, and readvertised again on the 9th of November, 18 1921; 19 1..1H1;2EAS, due advertisement add notice of the offering of said bonds for 20 sale has been given, made and had, and not offer or bid for said bonds, or 21 for any part thereof, had been made to or received by the City of Newport 22 II Beach; 23 NOW .THEREFORE, it is resolved and determined by the Board of Trustees of 24 the City of Newport Beach as follows. 25 SECTION ONE. 26 Without further advertisement, publication or notioe, the Board of Trustees 27 of the City of Newport Beach determine to sell and will sell at private sale • 28 to the highest bidder for cash, the municipal bonds of Municipal Improvement to30 District No. 1 of the City of Newport Beach in the sum of $:'12,500.00 30 authorised by the qualified electors of said Distrbt at the special election 31 11 Geld on tae jta day of June, 1921, for the construction of a turning basin 32 -1- I • 2 3 4 5 M 7 8 9 10 11 12 13 14 15 LIM 17 18 19 20 21 22 23 24 25 26 27 • 28 . 29 30 31 32 in Newport Bay, but for not less than the rar value of said bonds, and all interest which shall have accrued at the delivery thereof. SECTION TWO. Any provision of Resolution No. 142 providing for the giving of any notice or advertisement for bids prior to the sale of said bonds, as in this Resolution provided for, is hereby repealed and set aside, but in all other respects, terms and provisions, Resolution No. 142 shall be and remain in full force and effect. The foregoing Resolution was passed at an adjourned regular meeting of the Board of Trustees of the City of Newport Beach held on the 28th day fof November, 1921, by the vote of the following named members of said Board of Trustees, to wit: AYES, TRUSTEES: J.P. Greeley, J.J. Schmitken, Geo. P. ;�,'ilson, Conrad Richter, O.H. Burke. NOES, TRUSTEES. NONE ABSENT TRUSTEES: NONE.
