HomeMy WebLinkAbout383 - Central Avenue Improvements• RESOLUTION NO. ?J3 • A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT BEACH DECLARING THEIR INTENTION TO ORDER THE IMPROVEMENT OF CERTAIN PORTIONS OF CENTRAL AVENUE, WITHIN SAID CITY, UNDER THE IMPROVEMENT ACT OF 1911, AND THE AMENDMENTS TO SAID ACT. - - - - 0 - - - - The Board of Trustees of the City of Newport Beach do resolve as follows: • SECTION I That the public interest and convenience require, and it is the intention of the Board of Trustees of the City of Newport Beach, California, to order the construction of the following described work and improvement in said City, to-wit: (a) That that portion of Central Avenue lying between the northerly line of Section 1, Township 7 South, Range 10 West, San Bernardino Base and Meridian, and a line thirty -five (35) feet southerly of and parallel with the northerly line of.said Section 1, and extending from the westerly line of said Section 1. to a line, which line is 231 feet easterly of and parallel with the aforesaid westerly line of said Section 1, be graded, and that a cement concrete pavement be constructed upon the roadway of said described portion of Central Avenue including the construction of a cement concrete curb along the southerly side of the roadway of said portion of Central Avenue, and a cement concrete sidewalk along the southerly side of said portion of Central Avenue, and that cement pipe sanitary sewers together with manholes, cast iron frames and covers, lampholes and other appurtenances be constructed • on the grades at the elevations and along the lines of said sewers in that portion of Central Avenue hereinbefore described from the westerly line of the aforesaid Section 1 to a line, which line is 221 feet easterly of and parallel with the westerly line of the aforesaid Section 1. - 1 - 0 (b) That cast iron pipe and other appliances and appurtenances • for supplying and distributing domestic water be constructed along the southerly curb line of Central Avenue from a line, which line is nine (9) feet westerly of and parallel with the easterly line of L- Street, to a line, which line is two hundred thirty -one (231) feet easterly of and parallel with the westerly line of the afore- said Section 1. (c) The grades to which the work provided for shall be done and the improvement made upon the portions of Central Avenue here - inbefore described, which are provided for in this Resolution, are the grades shown on the profiles therefor on file in the office of the City Engineer to which said profiles reference is hereby made for the descriptions of such grades. (d) For all purposes of this proceeding that certain public street in the City of Newport Beach described as beginning at the northwest corner of Section 1, Township 7 South, Range 10 West, San Bernardino Base and Meridian; thence due east along the north- erly line of said Section 1 a distance of two hundred thirty -one (231) feet to a point; thence due South along a line, which line is two hundred thirty -one (231) feet easterly of and parallel with the westerly line of the aforesaid Section 1, a distance of thirty -five (35) feet to a point; thence due West along a line, which line is thirty -five (35) feet southerly of and parallel with the northerly line of the aforesaid Section 1, a distance of two hundred thirty -one (231) feet to a point in the westerly line of the aforesaid Section 1; thence due north along the westerly, line of the aforesaid Section 1 a distance of thirty -five (35) • feet to a point, the place of beginning, is herein referred to and designated as Central Avenue and the name thereof is hereby declared to be and established as Central Avenue, and so referred to. - 2 - .. e (e) All of the foregoing work and improvementis fully set • forth, delineated and described on plans, profiles, cross - sections and detailed drawings No. 330, on file in the office of the City Engineer of said City, heretofore approved by the Board of Trus- tees of said City on the c2 4day of �p 1926, by Resolution No. 3 p and in Specification No. 27 adopted by Resolution No. 97, as said Specifications No. 27 are amended by Resolution No. 131, and in Specifications No. 36 adopted by Resolution No. 302, and in Specifications No. 39 adopted by Resolution No. 346 of the Board of Trustees of said City, and on file in the office of the City Clerk of said City. The said plans, profiles, oross- sections, detailed drawings and specifica- tions are hereby referred to for the full and detailed description of the said proposed work and improvement. SECTION II. That the Board of Trustees also determine and declare that serial bonds bearing interest at the rate of seven_,;. per cent (7 %) per annum shall be issued to represent each assess- ment of twenty -five (25) Dollars or more remaining unpaid for twenty (20) days after the date of the warrant. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the fifteenth (15th) day of the next November following their date. Payments on the principal of unpaid assessments and interest shall be made by property owners to the City Treasurer and the same shallLbe disbursed by him, all as provided in the said Improvement Act of 1911. SECTION III. • That the contemplated work and improvement hereinbefore` mentioned is, in the opinion of said Board of Trustees, of more - 3 - F o • than local or ordinary public benefit, and the expense of said work • and improvement is made chargeable upon the district hereinafter described and said Board of Trustees do hereby declare said dis- trict to be the district benefited by said work and improvement, and to be assessed to pay the costs and expenses thereof, which district is bounded and described as follows, to -wit: Beginning at the northwest corner of Section 1, Township 7 South, Range 10 West, San Bernardino Base and Meridian; thence due East along the northerly line of the aforesaid Section 1 a distance of two hundred thirty -one (231) feet to a point; thence due South along a line, which line is two hundred thirty - one (231) feet easterly of and parallel with the westerly line of the aforesaid Section 1, a distance of six hundred sixty (660) feet to a point; thence due West along a line, which line is six hundred sixty (660) feet southerly of and parallel with the northerly line of the aforesaid Section 1, a distance of two hundred thirty -one (231) feet to a point in the westerly line of the aforesaid Section 1; thence due North along the westerly line of the aforesaid Section 1, a distance of five hundred fifty (550) feet to a point; thence westerly in a direct line to the southeast corner of Lot 2, Block Mp of Tract No. 518, as recorded in Miscellaneous Mape, Book 17, pages 33 to 36,both inclusive, Records of Orange County, California; thence westerly in a direct line to the southwest corner of Lot 1, of the aforesaid Block M; thence westerly along the westerly prolongation of the southerly line of the last mentioned Lot 1, a distance of thirty (30) feet to a point; thence northerly along a line, which line is thirty (30) feet • westerly of and parallel with the easterly line of L- Street, a distance of one hundred ten (110) feet, to a point in the center line of Central Avenue; thence easterly in a direct line, a distance of one hundred twenty (120) feet to the place of beginning, except- ing therefrom any lands forming any part of any public street or alley. - 4 - • The above description is general only. A plat or map • of said Distriot, No. 331, adopted by Resolution No. .�.3000 of the Board of Trustees of said City, indicating by a boundary line the extent of the territory included in the proposed district, is on file in-the office of the City Clerk. Reference is hereby made to said plat or map for a further full and complete description of the said assessment district. The said map or plat so on file shall govern for all details as to the extent of the said assess- ment district. SECTION IV. Notice is hereby given that on Monday, the 23rd day of August, 1926, at 7:30 o'clock, P.M., in the Council Chamber of the City gall of the said City of Newport Beach, any and all persons having any objections to the proposed work or improvement or to the extent of the district, or both, may appear before the said Board of Trustees and show cause why said proposed improvement should not be carried out in accordance with this Resolution. SECTION V. The Newport News, a weekly newspaper printed, published and circulated in the City of Newport Beach, is hereby designated as the newspaper in which this Resolution of Intention shall be published, and for the publication of all other notioes, resolu- tions, orders or other matter required to be published by the provisions of the Improvement Act of 1911 hereinagter referred to, and the City Clerk of said City is hereby directed to cause this Resolution of Intention to be published by two insertions in said • newspaper in the manner and form required by law. The Board of Trustees do no deem it advisable that the Clerk mail copies of the notice of improvement to owners, or reputed owners, and he is not required to mail the same. - 5 - x. r • SECTION VI. The Street Superintendent of said City shall, after the • adoption of said Resolution of Intention, cause to be conspicuously Posted along the lines of said contemplated work or improvement, and along all the open streets within the hereinbefore described assessment district, notices of the passage of this Resolution of Intention, in the manner and form required by law. SECTION VII All the proceedings for the aforesaid work and improve- ment shall be had and taken under and in accordance with the pro- visions of an Act of the Legislature of the State of California, desigMated as the "Improvement Act of 1911 ", approved April 7th, 1911, and Amendments thereto.
