HomeMy WebLinkAbout413 - Vacation of Pacific & Marguerite Avenues, • RESOLUTION NO. 77 ✓• A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT BEACH DECLARING VACANT FOR PUB- LIC STREET PURPOSES CERTAIN PORTIONS OF PACIFIC DRIVE AND MARGUERITE AVENUE 71ITHIN SAID CITY. ------- 0- - - - - -- 7THEREAS, the Board of Trustees of the City of Newport Beach, on the 20th day of December, 1926, at a regular meeting of said Board held on that date, duly passed and adopted a Resolution, being Resolution No. 403, entitled, "A Resolution of the Board of Trustees of the City of Newport Beach declaring their intention to vacate, close -up and abandon for public street purposes certain portions of Pacific Drive and Marguerite Avenue, within said City"; and 'iThEREAS, the Street Superintendent of the City of Newport Beach, after the passage of said Resolution, caused to be conspicuously posted along the line of said contemplated improve - went, at not more than three hundred (300) feet in distance apart and not less than three (3) in all, notices of the passage of said Resolution, said notice being headed "Notice of Public Works" in letters not less than one (1) inch in length, and stating the fact of the passage of said Resolution, its date, and briefly the work of improvement proposed, being that of vacating the above named streets as hereinafter described, and the said notice herein mentioned referred to said Resolution for further particulars; said Street Superintendent having also caused a notice similar to that hereinbefore referred to to be published by four (4) successive insertions in the Newport News, a weekly newspaper printed, published and circulated in said City of Newport Beach (there being no daily newspaper so printed, published and circulated in.said City), and more than ten (10) days after the expiration of the time of - 1 - . publioation of said notice having elapsed and no objections to • the said improvement have been delivered to the City Clerk of the City of Newport Beach, and the said Board of Trustees having acquired jurisdiction to order the vaoation of said streets as hereinafter described; NOW, THEREFORE, the Board of Trustees of the City of Newport Beach do resolve as follows; ~�I SECTION I. That those portions of the oublio streets hereinafter described within said City, be closed -up, vacated and abandoned for publio street purposes, and the portions of said streets so closed -up, va.oated and abanddned for publio street purposes are desoribed as follows; All those portions of Pacific Drive and Marguerite Avenue described as beginning, at the interseotion of the south- easterly line of Larkspur Avenue and the northeasterly line of Pacific Drive; thence South 39 degrees 38 minutes West, along the southeasterly line of Larkspur Avenue a distance of 25.18 feet, to a point; thence South 57;degrees 13 minutes 45 seconds East, along a line which line is 25 feet southwesterly of and parallel with the northeasterly line'of Pacific Drive, a distance of 218.12 feet, to a point; thence easterly, northeasterly, northerly and northwesterly, around a Circular curve with a radius of 20.13 feet concave to the northwest, a distance of 55.26 feet, to a point in the southwesterly line of Coast Boulevard, which south- westerly line of Coast Boulevard is also the northeasterly line 4Fof Lot 2, Blook J. of Traot.No. 323, as per map thereof recorded in Misoellaneous Maps, Book 14, pages 40 and 41, Records of Orange County, California; thence southeasterly, southerly, southwesterly, westerly and northwesterly, along the northeasterly, easterly, southeasterly and southwesterly line of the aforesaid Lot 2, Blook J, and along the northeasterly line of Pacific Drive, to the place of beginning. _2- SECTION II That the public !work herein provided for is the closing- up, of the portions of streets herein described in Section I, and it appearing to the Board of Trustees that there are no costs, damages or expense occasioned by or arising out of said work, and that no assessment is "necessary to pay the costs, damages or expenses of said work, and that, therefore, no commissioners shall be appointed to assess benef6its and damages. SECTION III The City Clerk shall certify to the passage of this Resolution and shall cause the same to be published by one (1) insertion in the Newport News, a weekly newspaper printed, published and circulated in said City and which is hereby designated for that purpose.
