RESOLUTION NO. 14 6 J
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH, CALIFORNIA, DECLARING THE NECESSITY FOR PRO-
VIDING FOR THE REPAIR AND UPKEEP OF THE CITY PIERS
AND LANDINGS LOCATED WITHIN SAID CITY, AND PROVIDING
FOR THE PAYMENT OF CERTAIN TOLLS OR FARES FOR PERSONS
USING SAID PIERS WHARFS OR LANDINGS, AND PROVIDING
FOR THE COLLECTIGN OF SAID TOLLS, RATES OR FARES.
WHEREAS, The City of Newport Beach is the owner
and in possession and control of that certain wharf heretofore
acquired from the Southern Pacific Company, and which extends into

and over the waters of the Pacific Ocean; and
WHEREAS, the City of Newport Beach is also the
owner and in possession and control of that certain wharf heretofo
constructed at the Southerly end of Main Street, Balboa, City of
Newport Beach, which extends into and over the waters of the
Pacific Ocean; and
WHEREAS, both of said wharfs or piers have a
landing or floating structure connected by a stairway to the deck
of said wharfs or piers, which said floating structures or
landings are now being used by various individuals, co- partnerships
and corporations for the purpose of embarking passengers on boats
and vessels plying in the Pacific Ocean; and
WHEREAS, heretofore said individuals, corporation
and co- partnerships have used said landings located on said piers
for the purpose of embarking passengers as aforesaid without the
payment of fees or tolls to the said City of Newport Beach; and
WHEREAS, the said City of Newport Beach has
maintained and kept in repair said piers or wharfs, together with
said landings and stairways leading to the same, at their sole
cost and expense; and

WHEREAS, the said City of Newport Beach deems
it necessary and expedient to provide a fund for the maintenance
and repair of said wharfs or piers, together with the stairways
and landings thereon; and
WHEREAS, the City of Newport Beach further finds it
necessary that said wharfs or piers, together with the landings
and stairways thereon be policed, guarded, regulated and kept
clean;
NOW, THEREFORE, BE IT RESOLVED: That every person,
corporation or co- partnership using said stairways and landings on
said wharfs, or either of them, shall first pay to the City of
Newport Beach the sum of five cents for each passenger embarked
by them on boats or vessels plying in the said Pacific Ocean, and
provided further that if said sum of five cents has not been paid
previously by such person, co- partnership or corporation, then
every person using said stairways and landings for the purpose of
embarking on boats or vessels shall first pay to the said City of
Newport Beach the sum of five cents.
BE IT FURTHER RESOLVED: That the policing of said
wharfs and the collecting of fares thereon be placed under the
Ijursidiction of the Police Department of the said City of Newport
Beach;
BE IT FURTHER RESOLVED: That the Chief of Police
of the said City of Newport Beach, together with the Police
Commissioners thereof make all proper and necessary arrangements
for the collecting of the sums of money herein provided for, and
for the proper policing, guarding and keeping clean of said wharfs,
landings and stairways thereof, and that all moneys collected be
placed in the general fund of said City;
BE IT FURTHER RESOLVED: That said sums of money

shall not be collected from City, State or National Officials,
or from any person in the employ of the United States Government. •0(
