A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, GRANTING A WRITTEN LICENSE

TO JOHN LOTH OF NEWPORT BEACH, GRANTING HIM
THE EXCLUSIVE PIER RIGHTS TO HAVE AND SELL LIVE

BAIT ON THAT CERTAIN PIER OWNED BY THE CITY OF jl
NEWPORT BEACH, BEING THAT PIER WHICH EXTENDS

INTO AND OVER THE PACIFIC OCEAN FROM THE SOUTH-
ERLY END OF MAIN STREET, BALBOA, BEING THE WHARF
8
ERECTED BY THE FUNDS OF MUNICIPAL IMPROVEMENT
DISTRICT NO. 1, OF THE CITY OF NEWPORT BEACH, FOR

A PERIOD OF THREE YEARS , UPON CERTAIN CONDITIONS
SET FORTH IN A WRITTEN CONTRACT THIS DAY PRESENTED

TO THE CITY COUNCIL, AND AUTHORIZING THE MAYOR OF
SAID CITY AND THE CITY CLERK OF SAID CITY TO
11
EXECUTE SAID CONTRACT FOR SAID CITY.

WHEREAS, pursuant to instructions, the City Attorney of
13
the City of Newport Beach has this day prepared a contract and
14
presented the same for consideration to the City Council of the
16
City of Newport Beach, in which said contract the City of Newport
18
Beach grants to John Loth of Newport Beach, a license to have the
17
exclusive pier rights to have and sell live bait on that
18
certain pier owned by the City of Newport Beach, being that pier
19
which extends into and over the waters of the Pacific Ocean from i
20
the southerly end of Main Street, Balboa, being the wharf erected
21
by the funds of Municipal Improvement District No. 1 of the City
22
of Newport Beach, upon certain conditions and specifications set
23
forth in said agreement and for the time specified in said agreements.

NOW, THEREFORE, BE IT RESOLVED: That said contract
25
be, and the same is hereby approved as written, by the City Council

of said City of Newport Beach, and the Mayor of said City and the

City Clerk of said City shall, and they are hereby authorized to

sign the same on behalf of said City, and the Clerk is directed to

have the party of the second part, John Loth, execute said contract l
31
within two days from date hereof, and the said contract shall there
32
upon be filed and become a valid contract as between said parties.
