RESOLUTION NO. � 4D,
WHEREAS, the AIZRICAN LAFRANCE and FOAMITE C
have been awarded the contract for furnishing to the City of New-
port Beach, certain fire fighting equipment known as One 750
gallon motor propelled, triple combination pumping engine, water
tank and hose car; and
WHEREAS, the bid of said American LaFrance and
Foamite Corporation was made in accordance with the plans and
specifications of the City of Newport Beach, relative to said
equipment, which said plans and specifications provided that said
equipment should b e purchased on lease contract and on a monthly
payment plan; and
WHEREAS, said American LaFrance and Foamite Corpora-
tion, have offered in writing to substitute for the fire fighting
apparatus above mentioned, One Standard AMERICAN LAFRANCE
"MROPOLITAN" 6- Cylinder, 1000 Gallon Combination Rotary Gear
Pumping and Hose Car with 80 Gallon Water Tank (Show Car); and
WHEREAS, said American LaFrance and Foamite
Corporation have offered to furnish said last above mentioned
equipment upon the same conditions and terms and for the same
price as said 750 Gallon motor propelled, triple combination
pumping engine, water tank and hose car; and
WHEREAS, said fire fighting apparatus offered to be
substituted as aforesaid, complies with the plans and specificat
of said City of Newport Beach in all respects, except that it is
much larger equipment and the same is now ready for immediate
delivery; and
WHEREAS, the City Council of the City of Newport
Beach believes that it is for the best interests and benefit of

said city that said Standard American LaFrance OMetropolitan"
6- Cylinder, 1000 Gallon Combination Rotary Gear Pumping and Hose
Car with 80 Gallon Water Tank be taken in lieu and stead of said
750 Gallon motor propelled, triple combination pumping engine,
water tank and hose car; and
WHEREAS, the total purchase price of said equipment
is the sum of Fourteen Thousand, Three Hundred Twelve and no /100
Dollars ($14,312900), payable in monthly installments as follows:
Three Hundred Dollaxs ($300900) on or before the tenth day of
the first month following date of acceptance of said apparatus,
and the balance in installments as follows: Three hundred
dollars (0300900) on the tenth day of each month thereafter
until Fourteen Thousand One Hundred Dollars ($14,1001.00) of
aforesaid rental shall have been paid, and Two hundred twelve
Dollars (0212.00) on the tenth day of the forty — eighth month
following date of acceptance of said apparatus; and
WHEREAS, the American LaFrance and Foamite
Corporation has presented a lease contract, providing for the
sale of said fire fighting equipment heretofore described,
to the City of Newport Beach for its consideration, which
said contract is in accordance with the specifications here -
inbefore referred to; and
WHEREAS, said contract has been submitted to the
City Attorney of the City of Newport Beach for examination,
and said City Attorney has approved of the form thereof.
NOW, THEREFORE, BE IT RESOLVED: That said contract
be, and the same is hereby approved as submitted and the Mayor
and City Clerk of the City of Newport Beach are hereby authorized;
directed and instructed to execute said contract in quadruplicated
in the name of and on behalf of the City of Newport Beach.

BE IT FURTHER RESOLVED: That one (1) copy of said
contract as executed by the Mayor and City Clerk, as herein
authorized, be retained and filed with the City Olerk of said
City, and that the other three copies thereof be returned forth-
with, to the Amerioan LaFranoe and Foamite Corporation, at Los
Angeles, California, for their approval, and that upon the same
being approved in writing, that an original duplicate thereof
be filed with the City Clerk of the City of NewportBeaoh.
I Hereby certify that the foregoing Resolution was
duly and regularly passed by the Oity Council of theOity of
Newport Beaoh, at a regular meeting thereof, held on the 23rd
day of Maroh, 1931, by the following vote, to —wit:
