A RESOLUTION Or THE CITY - OOUNCIL :__ CITY OF NEUPORT BEACH DECLARING THEIR INTENTION TO ORDER THE CLOSIdG UP AND ABANDONMENT OF A PORTION OF A CERTAIN STREET KNO11JN AS "M" STREET IN THE CITY OF NET ?PORT BEACH, DECLARIITG IT TO BE FOR THE PUBLIC INTEREST AND CONVENIENCE, AND FIXING THE TIME AND PLACE FOR HEARING OBJECTIONS TO SAID PROPOSED IMPROVEMENT. The City Council of the City of Newport Beach pursuant to the provisions of an act of the Legislature of the State of Calif- ornia, known as "Street Opening Act of 1559" approved March 6, 1559, and amendments thereto, do resolge and declare as follows: Section 1. That the public interest and convenience reouires the closing up and abandonment of a portion of that certain street as hereinafter described in the City of Newport Beach and it is the in- tention of the City Council of the City of Newport Beach to order the following street in said City to be closed up and abandoned, to -wit: All that portion of "M" Street as said "M" Street is laid out and shorn upon a map of Tract No. 756, recorded in Book 23, Pages 7 and 5 of Miscellaneous Maps, Records of Orange County, California, de- scribed as follows, to-r:it; beginning at the southeast corner of Lot 26 of said Tract 756, running thence north along the east line of Lots 26 - 20 and 12 of said Tract 756, 275.63 feet to the northeast corner of said Lot 12; thence easterly along the northerly boundary line of Tract No. 756, 40.50 feet to the northwest corner of Lot 27 of said Tract No. 756; thence south along the west line of Lots 27 and 29 of said Tract No. 756, 267.51 feet to the southwest corner of said Lot 25; thence resterly along the westerly prolongation of the northerly line of Central Avenue 40 feet to the point of beginning. All of which is more clearly shown on a certain Map approved • and adopted by the City Council of the City of Newport Beach for said abandonment by Resolution No. 7/ , on the / day of 1931 Section 2. That the said City Council of the City of • Newport Beach does further declare that the lots, lands or premises affected by the closing up and abandonment of the hereinbefore des- cribed street and benefited by said improvement are those certain parcels of real property described as follows, to -wit: Lots Twelve (12), Twenty (20), Twenty -six (26), Twenty -seven (27) and Twenty -eight (29) of Tract 756 as recorded in Book 4, Pages 7 and 9 of Miscellaneous Maps, Records of Orange County,Calif ornia. Section 3. That the proceedings for the closing up of the aforesaid street shall be had and taken under and in accordance with an Act of the Legislature of the State of California, designated asl known as "An Act to Provide for Laying Out, Opening, Extending, Widening, Straightening or Closing up in Whole or in Part of an y Street Square, Lane, Alley, Court or Place within Municipalities, to Condemn and Acquire any and all Land and Property Necessary or Convenient for the Purpose ", approved March 6, 1599, and amendments thereto. Section 4. The Street Superintendent eh all cause to be conspicuously posted along the line of said contemplated work and improvement and at not more than 300 feet in distance apart, but not less than three in all, notices of the passage of this Resolution, in the form and manner as required by law; and he shall also cause a notice similar in substance, for a period of four (4) successive weeks, to be published in the Newport News, a weekly news- paper, published, and circulated and of general circulation in the City of Newport Beach, California, and hereby designated for that Alk purpose by the City Council, containing a statement of the fact of the passage of this resolution of intention, the date thereof, and briefly describes the work or improvement proposed and referring to this Resolution for further particulars. Section 5. That any person interested, objecting to said work or improvement, or to the extent of the district or lands to be -2- • 0 i affected or benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, may make written objections to the same, within ten (10) days after the expiration of the time of the publication of said notices, which objections shall be delivered to the Clerk of the City Council of the City of Newport Beach. I hereby certify that the foregoing Resolution was duly and regularly introduced, passed and adopted by the City Council of the City of Newport Beach, at a regular adjourned meeting thereof, held on the Zd�� day of Jt 1931, by the following vote, to -wit: AYES: Councilmen����G/�.
