as appears from the affidavit of John A. Siegel, Assistant Street <br />• Superintendent of the City of Newport Beach, and more than ten <br />(10) days having expired after the expiration of the time of the <br />publication of said notice within which protests or objections <br />to the proposed work or improvement might be made by any person <br />interested objecting to said work or improvement, or to the <br />extent of the district or lands to be affected or benefitted,by <br />said work or improvement and to be assessed to pay the cost and <br />expenses thereof; and <br />WHEREAS, at the next meeting of the City Council after <br />the expiration of said ten days after the expiration of the time <br />of the publication of said notice, and no objection to said work <br />or improvement having been made or on file, why said proposed <br />improvement should not be carried out in accordance with said <br />Resolution of Intention, the City Council of the City of Newpat <br />Beach having now acquired jurisdictionto order the said improve- <br />ment; <br />IT IS HEREBY RESOLVED AND ORDERED: That the public <br />interest and convenience requires the work hereinafter described <br />and the City Council of the City of Newport Beach hereby orders <br />the following work to be done and improvement made in the City of <br />Newport Beach as follows: <br />That the following portion of "M" Street in the City of <br />Newport Beach as hereinafter described be closed up and abandoned,to-wl <br />All that portion of "M" Street as said "M" Street is laid <br />out and shown upon a map of Tract 756, recorded in Book <br />23, Pages 7 and 8 of Miscellaneous Maps, Records of <br />Orange County, California, described as follows, to -wit: <br />• Beginning at the southeast corner of Lot 26 of said Tract <br />755, running thence north along the east line of Lots 26, <br />20 and 12 of said Tract 756, 275.63 feet to the northeast <br />corner of said Lot 12; thence easterly along the northerly <br />boundary line of Tract 756, 40.80 feet to the northwest <br />corner of Lot 27 of said Tract 756; thence south along <br />the west line of Lots 27 and 28 of said Tract No. 756, <br />267.51 feet to the southwest corner of said Lot 28; thence <br />westerly along the westerly prolongation of the northerly <br />line of Central Avenue 40 feet to the point of beginning. <br />-2- <br />
