RESOLUTION DECLARING RESULT OF ELECTION RESOLU4"t6N NO .• 718. WHEREAS, a special election was held in that territory known as "Newport Heights Addition ", on Tuesday, the 27th day of October, 1931, pursuant to the provisions of An Act of the Legislature of June 11, 1913, relating to the annexation of territory of municipalities, and found in the Statutes of 1913, page 587, as subsequently amended, at which election there was submitted the question of whether said new territory hereinafter described should be annexed to, incorporated in and made a part of the City of Newport Beach; and WHEREAS, notice of said election was given by publication, in the time, form and manner as required by said act, as appears from the affidavit of %W on file with the City Clerk; and WHEREAS, it appears that said special election was duly held in accordance with law and said notice on Tuesday, the 27th day of October, 1931, and that the polls for said election were kept open during the time required by law, to -wit, from six o'clock A. M. to seven o'clock P. M. of said day, and that said special election was held and conducted, and the votes thereof received and canvassed, and the result thereof determined and declared, in the time, form and manner required by law; and WHEREAS, the City Council of the City of Newport Beach did on Monday, the 2nd day of November, 1931, being the time provided for its regular meeting next after the expiration of three days from and after the date of said election, meet and proceed to canvass the returns of said special election as required by law. 0 .- rL 1 2 3 4 5 6 7 8 ti 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 • 28 29 30 31 32 ROLAND THOMPSON ATTORNEY AT LAW SANTA ANA. CALIF. I- (' Whereupon, the result of said canvass having been found to be as hereinafter stated, The City Council of the City of Newport Beach do resolved as follows: 1. That the new territory proposed to be annexed to said City of Newport Beach as aforesaid is particu]a rly des- cribed as follows, to -wit: All that territory situated in the County of Orange, State of California, described as follows, to -wit: Beginning at the point of intersection of the center line of old County Road as laid out and shown upon a map of Tract No. 27, recorded in Book 9, page 26 of Miscellaneous Maps, Records of Orange County, California, with the easterly line of Newport Avenue, as laid out and shown upon Sheet 37 W of the Official Map of Orange County, on file in the office of the County Surveyor of said Orange County, said point of intersection being an angle point in the present City boundary of the City of Newport Beach; thence northwesterly along said easterly line to an inter- section with the center line of 16th Street as laid out and shown upon a map of Newport Heights recorded in Book 4, page 83 of Miscellaneous Maps, Records of Orange County, California; thence southeasterly along the center line of said 16th Street to a point 825 feet southeasterly from the intersection of said center line of 16th Street with the center line of Irvine Avenue as shown upon said map of Newport Heights; thence southwesterly along a line parallel with the said center line of Irvine Avenue 1320 feet to an intersection with the southeasterly prolongation of the center line of 15th Street as laid out and shown upon said map of Newport Heights and the Map of First Addition to Newport Heights as recorded in Book 4, page 94 of Miscellaneous Maps, Records of said County; thence northwesterly along the last mentioned southeasterly prolongation 825 feet to an inter- section with the said center line of Irvine Avenue which point is an angle point in the present City boundary line of the City of Newport Beach; thence northwesterly, southwesterly, and southerly along the present boundary line of the City of Newport Beach to the point of beginning. 2. That there was but one election precinct established and provided for the holding of said special election the boundaries of which were the boundaries of said territory. 3. That the whole number of votes cast on said proposition in the territory to be annexed as aforesaid was _/0 and the number of votes cast therein in favor of annexation was . /and the number of votes cast therein against annexation was 6/7 -2- 1 2 • 3 4 5 6 7 8 9 10 11 12 13 14 15 16 • AND, WHEREAS, it appears from the canvass of the returns of said election held in the territory proposed to be annexed to said City of Newport Beach, that the majority of all the votes cast in said outside territory on the question of said annexation are against annexation, IT IS HEREBY ORDERED, that a record be made and entered upon the minutes of the City Council showing the total number of votes cast upon said question at said election, the number thereof cast in favor of annexation, and the number thereof cast against annexation, and the City Council further finds that as a result of said election the proposition of annexing said territory to the City of Newport Beach is defeated.
